Hey Guys,

I sincerely apologize if this is redundant and someone else has already asked this, but I was hoping I could explain my situation a little...

I am an American living in Denmark with my Danish wife. I have a Family Reunification visa under EU law and have been here almost a year. We want to move back to the US and are trying to find the quickest way to do so. I was mostly curious whether or not it is possible for her to come into the US and then apply for everything in the states? Also, we saw something about a Direct Consular Filing that can speed up the process of her getting a visa; does anyone have any experience with that?

Any strategies would be greatly appreciated! Thanks so much everyone!

Peter, there is no Direct Consular Filing in Denmark, so you would need to follow the path for IR/CR visa.

Although many do and get away with it, coming into the US on a non-immigrant visa - i.e. VWP or B2 - with the intent of staying, as you propose, is considered immigration fraud. I would not advise taking that route.
