Hi all,

I submitted my paperwork for my AOS (1-485) in early February and had my biometrics in early March. After reading on here that green cards are taking a year to process I have realized that I should have put in for my EAD card and that it would have been free. I assumed there was an extra charge. Anyway I have been reading that it's not too late to apply for an EAD card and that it is still free. Is this true? Has anyone else done this? Will this make things more complicated?

Yes, you can apply for the EAD for free as long as your AOS is pending. Make sure to enclose a copy of your AOS receipt notice (I-797C). Check the instructions on the USCIS website:

What do I put for question 15 and 16 for i-765?

I originally entered on a K1 visa and my AOS is pending.

Also, can i-765 be sent in with the notification form, G-1145 to say it has been received?

I will apply for I-131 later if I intend to travel.

So in total all I need to mail in is the 1-765 form and a copy of i-797C?

Thank you! I read the instructions part but I was unsure if the photos were still required so thank you for clarifying.

I just have two more questions before I mail off.

1- My K1 Visa has expired now, so do I still put k1 as my current immigration status?

2- It says government issued ID, so is it ok to just scan my passport identification page instead of my K1 visa page?

Yes, you can still put "K1".

I have included a copy of both my passport bio-page and K-1 visa with CBP stamp. It's just 1 more page anyways, why not? :)

Do not wait until you want/need to travel to apply for AP. It will take too long to process, and you never know if an emergency could happen that would make you need to the leave the US quickly. No plans to travel needed to apply. I have seen plenty of people post about how they wished they had filed for AP right from the start when they had the chance. If you file for the EAD and AP at the same time, then you will most likely receive an EAD/AP combo card. Both forms have their fees waived when filed with a pending I-485, and the I-131 is a pretty short and easy form to fill out.

Yes, when filing for AP, some sections are skipped. For the date and length of trip, leave them blank and then hand-write Unknown for those after you print out the form. Also, no explanation statement of why you want/need the AP is needed when filed with a pending I-485. You just provide a copy of your I-485 receipt notice with the I-131 too. And yes, you will need a total of 4 passport photos for the I-765 and I-131 together.

Thank you for the list! You have been very helpful! I have all my documents ready now. I am going to get my passport photos done and I will hopefully mail everything off today :) I'm glad you encouraged me to apply for the AP too, because it's true - an emergency could happen and with the AP I would be able to leave without hesitation.

Just checking...for part 4, do I write unknown for that too?

I read that someone sent in a copy of their marriage certificate too, is that required for i-131 or i-765? I already sent in a copy with my pending i-485.
