Hi Group,

I could really use some help... I am hoping someone out there has run into the same situation. My husbands I-130 just got approved we are waiting to hear from the NVC. I know the next step includes the I-864 AOS.

A little background. I have lived abroad in Panama with him for the last 4 years. We got married last June 15th here in Panama. I do not have any source of income and have not for a couple years. I did file taxes as exempt in 2011. We currently live off of his income and my shrinking savings. I filed taxes this last year only because I cashed in a small IRA fund. But there was no employment income (W2) for the past 3 years. I was advised to file single this year YIKES??!! So I am thinking this will cause more trouble then helping. The IRA was only a few thousand dollars. None of this is even close to the poverty level for support. I still have a bank account in the states, my drivers liscence, and I am registered at a local community collge full time.

There is a line on the I-864 that says the immigrants income can be used for AOS if it will continue from the same source. He is currently employed by a Huge worlswide shipping company that has many branches. He will still be employed by the current branch until the end of 2014 (even when we move to the US). After that he will transfer/be employed by a seperate branch in the US. All of his current income is from Panama so there are no taxes or W2's. His income is over the 125% poverty level.

Does anyone have experience using the immigrants income ($0 income from the sponsor) as AOS from a foreign country without having taxes to accompany the aplication? I know he does not need to file for I-864a. We can just file the regular AOS forms? We can get a current letter of employment and paystubs. Any insight on first had experience would be very helpful.

We are on the same boat people I am a full time student have no income only solution is to get a co-sponsor I have heard stories of getting to the interview and getting denied because of the I-864 and not enough income I'm really scared for that. following good luck.

You need to file married, not single.

If he can get a letter from his employer stating that his income is X (ie above the poverty line), and they will continue to employ him when he moves to the USA, that should be ok.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thanks for the help. We are working on the letters of employment. HE is well over the 125% poverty level with his current income and when he transfers to the US his income will increase. So we do have enough for the AOS. It has to come from head of HR in the states so it is taking a while.

As for the taxes. I talked with a tax attorney and he said it is best to wait until my spouse has a SSN to amend. Does anyone know if a letter explaining my confusion with filing and plans to amend once my husband the intended Immigrant has a SSN will be acceptable? If possible first hand experience would be great.

ITIN for taxes.

I have seen people use the continuing Immigrants income. Should not be an issue, but no common, probably not common at all for this Consulate.

Hope he will get a pay rise.
