Hey guys so I have a couple questions for you,

How do we calculate the gross annual income to put on my fiancé's sponsor form for my AOS?

Am I correct in thinking we do weekly wage x 52 (weeks in a year) or do we do monthly wage (so weekly wage x 4) x 12 (months)? it seems to give me different answers, haha. The first one would put him over the 125% but the second would put him slightly under.

I ask this because he did his first tax return last year, but it only picked up like a little bit of the income (he started work in September, and has also had two raises since then, so it's only counted from September til when the taxes were done at that hourly pay) so we don't actually have a number.

Ooor do we just have to write down what the tax return said? Which would obviously not be above the 125% at all. Either way, we have a co sponsor so I know we'll be fine, it would just be really cool if it did work out as him making over the 125% ^^

And and also, my fiancé's job has like, an hourly wage, but he also gets commissions from sales too? So if we did have to calculate it ourselves, how would we include the sales? Or would we omit them?

And lastly, do we need to write a letter saying the reasons he did not file tax returns for the years before that? He had zero income and was in college, so is that a sufficient explanation?

For 2014, take his wage per pay period and multiply that by the number of pay periods per year. This will be much more accurate.

For example, if he's paid weekly, then multiply by 52wks. If he's paid every two weeks, then multiply the wage per pay period by 26. Some people are paid twice a month, so the pay period multiplier would be 24 in this case.

The only month that has four weeks is February, so that method is prone to an underestimation of earnings.

Yes, his weekly pay rate times 52 weeks. You use that amount for his current annual income. You put the Total Income amount from his taxes where it asks. They are usually not one in the same.

Commission is tricky because there is no set amount. You could just put his current income as '$XX,XXX + commission', and perhaps the letter from his employer could state he makes his hourly rate plus whatever % commission. Provide a copy of his most recent pay stub(s) as well. OR you could estimate how much commission he would make annually and add that into his current annual income amount, but you would need to provide documentation of the commission amount.

For any year he did not file taxes, leave those lines blank and provide a statement explaining why he was not legally required to file those years.
