what is the process to get amendments to your sole custody documents

Seems like NVC/consulate needs specific details for people with sole custody of children. If you have gotten your court orders amended please share your experience with us. How did you go about doing this? Was it on your own or did you get a lawyer? Did you have to goto court? Or could this be done through the court clerk?

If you have any experience please share so others can have some idea of what they need to do (like myself).

Go to the family courthouse that issued it and speak to a clerk of the court. Depending on what needs to be amended it might be a simple thing...

***THEY CAN NOT GIVE LEGAL ADVICE*** but they may be able to tell you if it's an application you can do without counsel or not.

It's been many years since I've assisted in family law and even that was...pretty short lived. Sorry I'm not much help.

May 29, 2013 - Finally!!! I-129F and associated forms delivered!

June 3, 2013 - NOA1!

August 19, 2013 - NOA2! (email)

October 10, 2013 - NVC has our case, Vancouver number assigned

***Communications with Vancouver begging to put my case on hold a while due to house not selling!!!***

February 20, 2014 - Packet 4!!

May 5, 2014 - Medical

May 7, 2014 - Consulate Interview

May 13, 2014 - K1 visa in hand!!!

July 2, 2014 - POE (Sweetgrass)<p>

July 23, 2014 - apply for EI (mother of god that was confusing...)<p>

August 11, 2014 - finally get hitched!

My daughter's father is an absentee dad so I got sole custody when she was about 5/6 to ensure I had the right to do whatever I needed to do without having to try to find him to get permission.

Fast forward 10 yrs when we were preparing for our K1 interview and she was 15. I had heard that a 10 yr old document wasn't recent enough and of course I couldn't prove the situation had or hadn't changed. I went back to the same lawyer who had it amended to say that as of the current date there had been no changes since the original court order and that all original details/orders remained in place. I didn;t have to go to court or anything...the lawyer took care of it and I 'think' put it before a judge. I 'think' they made an attempt to contact the absentee father at the same last known address we'd had 10 yrs earlier and no response

The fee was between $300-$400 I think. Its just an addendum I attached to the original order.

Thanks so much for your response. I have sole custody of my son and was given child support. My son has never ever seen his bio father and i am really trying to so I'd trying to contact him ( although no one ever can and he never shows up to court) I think the child support is going to make things so difficult for me.

Thank you for your response anyway :-). Apparently i have to go back to court and file a bunch of forms.
