W2 and ITR (I-134 AFFIDAVIT OF SUPPORT)

Hi Vj's. My fist question. Aside of I-134 Affidavit of Support. Should I ask my fiancé about his W-2 of 2011 to 2013 and 1040 form for embassy? And what is this ITR mean? I so confused about this. And also about Evidence of having Relationship. Emails and Pictures are they have minimum and maximum of these? Were only have few chats, but he did calling me like everyday for about 1hr. Im worry about our emails :sleepy: and we don't have much photos like you guys have. We traveled together and go many places but we missed taking pictures sometimes.

To your questions:

YES! The petitioner (your fiance) must provide at least the previous three years of W2s and accompanying income tax returns.

2. And what is this ITR mean?

3. And also about Evidence of having Relationship. Emails and Pictures are they have minimum and maximum of these?

Proving a bona fide relationship is very important, especially if the VO has suspicion that one or both of you is being dishonest. You should have the same photos that depict the two of you together to prove a face to face meeting. For the interview, it's important to bring more. You needn't bring a photo album, but at least six more that have the date and location of the photo written on the back.

It is not necessary to include the entire content of an email, but a copy that shows the email header of your name and email address and his name and email address, date sent, subject, and so on. If you talk on the telephone or skype, get records of the time and dates of the phone calls. These should show the originating telephone number, the number called, and the duration of the call.

Don't worry that you didn't take dozens of photos or talk every day. What's most important is that you are able to show an on-going relationship over time.

You do not need the past 3 years of taxes. You only need to submit the most recent 1040 and W-2, which would be 2013.

A completed I-134 Affidavit of Support Form with original signature will be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You should also submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134.

Only need the most recent tax return and W-2, follow the embassy instructions letter for all requirements. DO NOT need multiple years of tax returns or W-2.

As for emails, phone and chat logs, just bring a sampling of each from over the months. With the pictures 4-6 of the two of you will be fine, if you have any with all your family include one or two of those.

Totally WRONG. The embassy does NOT require three years of tax returns.

Dude! One can get by and bring the minimum if they so wish. That being a little dab 'el do ya. Better to be prepared for all contingencies as there is no way of knowing what they will ask. So, yes, if someone has neglected to keep tax returns and W2s from previous years, they can just get by with whats they gots. Better to stuff the bag full before going to an interview, than to pack light because it's just a day trip.

The common sense aspect is to make sure to bring everything on the list. Unfortunately, while you watch the group sitting in what you call the paranoid corner, they will be looking back at your group sitting in the 'shoulda, coulda, woulda' wish I had a tissue corner.

Maybe that is an issue with the embassy in China.. don't know, don't really care. But in regards to the OP, who is processing through the embassy in Manila .... no need for paranoia. Bring what is listed in the embassy instructions letter is all that is needed...... no "shoulda, coulda, woulda" BS

Hey Jhammin. Just to add, do check if your fiance's most recent 1040 (This is the ITR.) line 22, which is the gross income, is well and above the poverty guidelines: http://www.uscis.gov/sites/default/files/files/form/i-864p.pdf

Consider the 125% value of his household size, that is "him + dependent (if any) + you". If the line 22 value of his 1040 is a good high value, then you only need to bring his "2013 1040 and W2". IRS transcript would work as well. Then you are good to go!

If the number on line 22 only meets it (say $20 k for a household of 2), you also have to ask for his employment certificate and recent paychecks (about 3 months),some Manila COs have been known to ask for this.There had been experiences months before that 3 years of 1040 + W2 was asked as well, if the petitioner's gross income is barely there.

If I were you, if your fiance has them in record, just ask him to send it to you via email. He can also get his IRS transcript online from here if he can't get hold of his 2012 1040 & W2: http://www.irs.gov/Individuals/Get-Transcript

I think your answer should also be acceptable. The example form here in VJ also says "no" http://www.visajourney.com/examples/DS-160-Example-Form.pdf

I agree with you that it is somehow a tricky question indeed as fiance is not legally defined as an immediate family. So don't worry too much about it now. If it comes up to the interview and I highly doubt it will, just be truthful on why you answered so. :thumbs:
