Hello! First of all I want to thank all the members for the great info you guys post here! it helped me in my immigration process. I need another advice please! I have been married for almost 3 years now. Our marriage has its ups and downs. We fight a lot, my husband calls me names and just says very insulting things. I tried to do everything to please him, but it is never good enough. I am very tired. He threatens to kick me out and "send me back home" as if i was not a person, but a kind of a useless package. i feel like i live in a cage. can't talk to people, can't leave the house, can't see my friends or family. he goes out a lot and i stay at home and wait for him to come home drunk. That's the short version of our sad story. I am thinking about leaving him, it is better for my health. We filed for my ROc jointly about 3 months ago, so i have several question, any help would be greatly appreciated:

1. If i file for a divorce now, whats going to happen with my pending ROC?

2. Will i have to resubmit all the evidence?

3. What if my divorce is not finalized in the time that USCIS gives for it? Will i be in removal proceedings?

4. How long does it take to process this kind of cases?

I have no money to go to the lawyer, so this website is my only hope! We've tried to work it our, it is not going to work. Never though that marriage would be like that.

1. You need an immigration lawyer, not from this website with your situation. Divorce can't take months or years to finalize, even more if your spouse is not willing to part ways. And you mentioned you can't afford lawyer, so my personal thought is to lay low until your case is approved. You can travel or stay away from him for a while. USCIS doesn't know about your divorce if it is still pending, the ROC could be finished before your divorce is finalized. Just a friendly reminder, I have a friend, who divorced 2 months after she got her 10 years card, and you know what? At her recent citizenship interview, they asked for all bonafile evidences 8 YEARS BEFORE to prove that her former marriage was in good faith. And now she is spending many thousands for lawyers.

2. Yes beside what you have submitted, they might ask for more evidences to establish a good faith marriage.

3. As I said, they will not know what is going on with your marriage if the divorce is still pending. But if you have an interview for I-751, your marriage status will be asked and you need to explain that.

4. Complicated cases have varied timelines. No one can tell you exactly how long it would take.

It would be easier if you let forum know your timeline, service centers. Good luck.
