You guys only read what you know about immigration here.

But in reality, an immigration case can be opened based on almost anything. An immigration judge will always hear the case and grant an EAD based on anything. Subsequent hearings and appeals will likely result in GC.

In Gump's case, his hardship is that his American son needs treatment here, and needs Gump and wife to stay and support him.

If'n he's already been issued 'stuff',

then a carefully-worded letter back to the judge will move mountains.
