I will continue to let pushbrk help you as he's what I consider the expert on this issue.

No the tax return isn't useless, just more paperwork.

She must have messed up somewhere writing down an amount of how much she makes. I can't help you with that.

MY SITUATION IS LIKE :::::please read it and also see attached TAX return and then answer

*my wife fill up I-864 BUT LOW INCOME

*MY JOINT SPONSOR FILL UP I-864 HIGH INCOME BUT TAX RETURN WITH HIS WIFE

*SO HIS WIFE FILL UP I-864A

MY JOINT SPONSOR INCOME IS 90,000 $ INDIVIDUAL

HIS WIFE INCOME IS 80,000 $ INDIVIDUAL

THEY FILL UP BOTH INDIVIDUAL INCOME IN INDIVIDUAL PORTION IN I-864 & I-864A RESPECTIVELY

ALSO ENTER TOTAL INCOME AS REPORTED IN FEDERAL TAX IN I-864 IN PART 6 , 13a, AS 170,000 (UNCLE + AUNTY INCOME)

AND WIFE ENTER SAME AMOUNT FIGURE IN TOTAL INCOME AS REPORTED IN FEDERAL TAX IN I-864A IN QUESTION 11 LIKE BELOW :

[x] _______house hold member____________________________'s income indicated
on line 11 of the I-864A does not correspond to that shown on the most recent tax return and W-2(s).
BUT GOT INCORRECT ?????
I DO NOT UNDERSTAND WHY IS INCORRECT WHILE TAX RETURN IS SAME AS UNCLE AS FILL UP BOTH TOGETHER AND AMOUNT SHOULD BE SAME . ALL INCOME COMES FROM IRS TAX TRANSCRIPT.

Also please, stop yelling. Capslock is completely unnecessary.

What you need to do is:

Have your joint sponsor fill out and sign a new I-864 including his 2013 tax information. If he qualifies on his own then his wife does not need to complete an I-864a. He can send his entire tax return including any schedules and his W2 which will indicate only his income.

or

Have your joint sponsor fill out and sign a new I-864 including his 2013 tax information. His wife can complete an I-864a. They can send either the entire tax return (including schedules and both W2) or a tax return transcript which can be downloaded online from the IRS website or gotten at an IRS office.

You received this checklist after a case complete from the NVC so nothing new needs to be sent to the NVC for you to get an interview. You need to get the new tax information for the interview. Stop trying to correct something when you need a new one.

On line 10 of I-864A individual income is 86,500 and this is current individual income of 2013 not 2012..

I know we need three year IRS transcript , but we are talking about IRS 2012 and check-list is also for IRS 2012 ....which was most recent at the time of AOS submission.

My advise is to start over with a new I-864 and I-864a that use 2011, 2012 and 2013 tax information.

Current individual income has nothing to do with a tax return. 2013 is not "current". Current income is a different animal that past taxable income. She could have lost her job three months ago, making her current income zero, no matter what she earned in 2013.

It seems to me that you did, in fact, complete the I-864 accurately, but because it is now May, you're going to need an updated one anyway.

Also please, stop yelling. Capslock is completely unnecessary.

Have your joint sponsor fill out and sign a new I-864 including his 2013 tax information. If he qualifies on his own then his wife does not need to complete an I-864a. He can send his entire tax return including any schedules and his W2 which will indicate only his income.

Yes, on the point of not needing to correct the old affidavit(s) if the case is already complete. However, for joint filing married folks it is ALWAYS best to provide an I-864a from the spouse, regardless of whether the joint sponsor qualifies on their own.

In my opinion, you DID fill it out correctly the first time. I believe, that since NVC sent the case forward to Islamabad, you don't have a problem. Do the same thing when you update, and expect this to be a non-issue.

That should be fine. Please note that when including a tax return, it should be complete with all schedules, W2 and 1099 forms. That's what is meant by a "complete copy of US Federal Tax Return". There is no need to include any State Tax Return. You should also include a pay stub or employer letter for each person with income, as verification of "current income". Tax returns are evidence of "past income". Current income is the key factor.
