An attorney will ask questions that delve into the situation more deeply than we do here at VJ. Based on a better understanding of the situation than we have the attorney will outline the option(s) that may be available and advise the approach that is in the person's best interest.

In the cases of Thee_Rak and Lenster there will be things that need to be said, things that can and should be left unsaid, and 'right' and 'wrong' ways to say the things that need to be said.

I appreciate the predicament that you are in. But remember that the G-325A is filed with the I-129F as one of the required documents in the Fiance Visa petition application. And when you sign the I-129F it says:

PENALTIES: You may by law be imprisoned for not more than five years, or fined $250,000, or both, for entering into a marriage contract for the purpose of evading any provision of the immigration laws, and you may be fined up to $10,000 or imprisoned up to five years, or both, for knowingly and willfully falsifying or concealing a material fact or using any false document in submitting this petition

Lying and getting caught is a very serious situation. Get solid advice from a qualified attorney.

But an attorney must advise the client to tell the truth, no?

The law is the law and if the OPs woman is considered a hooker by the USCIS because she's given blowjobs and handjobs for money, then we need to discuss waivers and whatnot...not trying to figure out a way to flippin DUPE the governement into not knowing.

Out of curiosity does it make any difference whether what she is doing is legal in Thailand and illegal in the US? I'm not sure if it matters either way, because I don't know Thailand laws, but if she is engaging in legal activities in Thailand, can then they really fault her or deny entrance to the US on that basis (I realize they can do what they want, but would they?)? Furthermore, I have heard of (but cannot profess to) many weird loopholes to prostitution laws in the US, and if she isn't preforming intercourse then there is some chance that they may not even consider it prostitution.

Anyway, definately don't lie... either list it and deal with questions later, or hire an attorney who can advise you much better than the yokels like us on VJ can.

I would not tell you to lie but I have a strong feeling that if you list it you will get denied. Even Bill Clintons definition of sex is different than those of many of us. I am sure prostitution can have different meanings to different people.

My former fiancee had worked her whole life in a jewlery workshop. She was paid cash and it was basically under the table work. When it came time to fill out the forms I told her just to list the place she worked. She refused and was afraid they would check and they and she would get into trouble. No matter how much I insisted she refused to put any work down at all. She basically filed it saying she had never worked a day in her life at age 28 and they never asked a thing about it.

I think you are between a rock and a hard place but the only thing I can say is to re-read my first sentance.

4/22/10 Filed for Removal of Contitions. 6/25 10 Year Green Card received Nov, 2014 Citizenship ceremony. Our journey is complete.

I appreciate that Americans have a a love of euphemisms, but in this case there could be many examples of people that work in the Sex Industry, say in a porno shop, but would not have an issue with US Immigration.
