Timeline

Today, while being at the bank with my hubby, so that he can put me on his bank account, the lady there told us that I need a state ID card in order to do that. They don't even accept USCIS cards (shock!), it needs to be a state ID. Anyway, I have filled for AOS in febr, my EAD is still in initial review and we should be having the AOS interview in the next 2 months (still waiting for an interview date). So my question is: can I go to the DMV with the AOS NOA1 to show proof of legal presence? Looking on the ID card requirements is says I need I797, Notice of Action, but my noa1 is I797C?

I'd like to go to the DMV on Monday, so that we can fix the bank account situation once and for all.

Weird, I was added onto my hubby's bank account with just my foreign passport as ID. I suppose it must be different state to state.

An I-797 Notice of Action is only given when an application or petiton is approved.. So sounds like you will have to wait until your AOS is done with. Or maybe until your EAD comes through. Since you can legally work with an EAD, I find it hard to believe a bank would not accept that as valid ID for a bank account!

If a bank refuses to accept a federal ID, you should find another bank.

I used my passport to open bank account in U.S bank. Got my state id with passport and school transcript but this varies from state to state. I would think that all the bank will accept the same thing? Try check with other banks

It's different from bank to bank actually. We already have a joint bank account at another bank, and that bank had no problem in accepting my passport, marriage certificate and ssn. This one however(it's a local Federal Credit Union), won't accept neither of those, unless it's a DL or state ID. Hubby just told me that you cand open a bank account here ONLY if you're being recomended by another member..I mean WOW, what a fancy bank, right?!

I was thinking I might have to wait for the approval(I797), just wanted to be sure.

For some reason, hubby wants to keep this account, probably cause it has good interest rates?!

Timeline

Some Banks ask for 2 FORMS of ID Passport and State ID. I was in the Same Situation but I live in FL. I went to the DMV with my I-797C and I was given an ID Card for 1 year that says Temporary on it, the guy told me as soon as I bought my social security and green card I would get a regular one, so I was able to at least get a temporary one and the bank accepted it. So TRY but not all DMV's are the same. BTW the bank that asked for 2 forms of ID was Chase.
