Hi

I need to try and understand all the different dates with the I-129/ K-1 visa:

Lets see if I get these dates right:

  • I-129F is good for 4 months once approved and can be extended by the embassy (up to a year)
  • K-1 visa is good 6 months from the medical exam, plus you pass the interview (no extensions)
  • Once you step foot in the US you have 90 days to get married (no extensions)

I keep see this:"It is important to file for the AOS before the K1 expire date, otherwise you will be out-of-status". So may questions is, what is the expire date?

If you wait 5 months and 20 days to set foot in the US you have 10 days before the K-1 expire date and you are out of status?

At the moment you arrived to usa you are out of ''status''

Why? Because at the moment you use the k1 to enter to usa , k1 is expired.

K1 is valid for one enter.

the six months expiration date is all the time you have before enter to usa. But once you arrive k 1 isnt good no more.

But once you get marry before 90 days, you can do aos when you want.

You dont need do aos in the 90 days period.

Yes. The beneficiary is advised to undergo medical exam and interview once the petition is approved. He/she will receive instructions from the US Embassy.

  • K-1 visa is good 6 months from the medical exam, plus you pass the interview (no extensions)

Yes. In addition, the beneficiary must enter the US soil before the visa expires.

  • Once you step foot in the US you have 90 days to get married (no extensions)

You will become out-of-status once your I-94 lapsed or the 90 days had passed. That is why it is recommended to file the AOS once the marriage certificate is ready. Though not necessarily within 90 days. (I filed one month after, others were 10 months). BUT, the sooner the better.
K1 visa becomes invalid on the day of your arrival to the US. U
pon arrival, a CBP officer stamps the travel document of each arriving non-immigrant traveler with the admission date, the class of admission, and the date that the traveler is admitted until. You will retrieve your 1-94 online 2 weeks after the arrival.

No. You will only be out-of-status once your 90 days or the 1-94 expires.

File AOS before the I-94 expires or your are out of status. I-94 is good for 90 days. The K-1 visa expired the second you cleared POE, from that moment on the I-94 is your legal document for being in the USA

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Yes, the K-1 visa becomes null and void, but you are not out of status once you arrive. You are given an I-94 upon arrival, which controls your status. It is typically valid for 90 days. If you have not yet filed for AOS and your I-94 expires, then you will be out of status. If you marry within 90 days of entry, you are eligible to file for AOS and there is no deadline to file, but you will be out of status from the time your I-94 expires until you file. Filing for AOS places you in a new period of authorized stay.

This expiration date is nothing to worry about. As others have stated, it's "automatically" extended (actually I don't think anyone does anything about it) and as long as USCIS or NVC or the Embassy has your case, it's open.

  • K-1 visa is good 6 months from the medical exam, plus you pass the interview (no extensions)

Yes, good to use to come to the US. There have been cases where the Embassy has granted an extension.

  • Once you step foot in the US you have 90 days to get married (no extensions)

Yep, exactly 90 days.

There is none. You can AOS whenever you want....or never. Until you do though, you are out of status or actually have no status. You can not legally work and if you leave the US you won't be allowed back in without another visa.

No, once you POE, you have 90 days to marry.

Ah, just the information I was looking for!

Thank you for making it so clear- I wasn't sure what the "real" expiry date for marriage was (K-1 or 90 days)
