We Requested a Letter from my spouse's "Boss" and we mentioned what USCIS wants and next day we received it with the exact info, on the same day we expedited the letter to USCIS and it show on our Case online that they received it on June 10th, after that there is Waiiiiiiiiiiiiiiit

Did you check turbotax saving folder if you can retrieve the tax for 2013 ?

What we do each year we save the tax return file and send it to our emails both, Silly but it's worth

My spouse make around 62K, we sent the pay stubs for the last 6 months ( at the time we filed my AOS ) and clearly it states where my spouse work and what agency she's affiliated with, also we included a letter explaining why we don't have the tax return for 2012 and 2011 which also we indicated WHERE she works and still they sent us the RFE requesting a letter from the employer and the nature of the job and if there is a chance of promotion within the next few years ... Really

See this is why I worry about RFE so much like

My husband make enough for 2 people, and he has had his job since September 2013, so his tax return doesn't show how much he makes in a year. He didn't file the two years before that because he was in college, not earning any money. He wrote a letter explaining that

His job is remote/work from home, he work for a very big company but they hire in many states. It's also like, a salary + commission, so it varies, but at minimum it is still above the two person requirement.

We send all the paystubs we could, which show as he got two raises since he started , and he also has an employee file on the website where it says his position, that he's full time, who is boss is, how long he's been working etc, all the stuff an employer letter would ask for. He also wrote his own explanation of his job and how often he is paid.

I just worry that they will look at the tax return and think badly. It's low because he had just started at the starting wage. He's had two raises since then and his boss says he is one of the most valuable members of his team.

Ugh I just hope the paystubs and employee file is enough. I worry so much

Though I remember in London at my K1 interview, they looked at the I-134 to see the number was adequate, looked at like one paystub, and she said it was fine?? xD but I guess the I-864 is more important so they read into it a bit more

I mailed a copy of the federal tax return printed from turbo tax online, I am not sure if that's the reason, I am not sure how long it takes to get the tax transcript directly from IRS?

u can print it urself online dirctly from IRS just like i did

Yes, I am just confused if they will accept the letter from turbotax as proof of extension

You dont have RFE yet, I believe you are good, just pray and hope they move you to testing and interview, which is the final stage of this stressful AOS process.

Hello everyone, long time lurker, first time poster.

I have a long, long history with INS/USCIS, so if gaps appear in the story, it may be intentional as some of the events of my past are personal and I don't wish them all posted online.

To summarize with where I am at TODAY.

FB 3 preference (currently living in the US on a valid E2 visa) priority date become current in May of this year. Father sponsored me (and consequently my wife of 10 years) in 2003.

Atty sent in AOS package on May 23rd. Notices received for AP, 485 and EAD on May 28th.

Today, checked the USCIS website and noticed a RFE for initial evidence, so I'm a little freaked out. I haven't gotten the notice in the mail yet, so don't know what it is for. Nothing serious I hope!

Initial E2 visa approved (04/2005) - 2 consequent renewals

I will do that ASAP, thanks.

I'm sure the issue IS tax related, since I'm actually applying from a FB3 I130 from 2003 but yet can adjust from within the US due to my E2 status. I own my own business and my wife works, on her own EAD, for my parents business, just to complicate things more.

Still, we have excellent lawyers and excellent accountants. All should be a snap, if that's the case.

We file together, so the 864 would have been combined. I have no worries about proving employment, since we have a payroll company do our pay checks. We have access to 10 years of returns and pay stubs for myself, wife and my sponsor.

You should be fine. Get a letter from his company. Also if he has any assets or investments, include that as well.
