Apologies if this is covered elsewhere, I looked at the guides but didn't see an answer.

I am expecting an interview for my green card in the next month or so. I already have EAD/AP. Adjusting from a work visa (E-3).

All going well, my green card will be conditional, as my husband and I have only been married for one year.

My husband has been asked by his employer (US company) to take an overseas assignment. This would see us moving to Europe probably in January 2015, for up to two years, but with regular return trips to the US (probably for periods of one month, twice a year.)

I understand this will have implications in terms of lengthening the time it takes me to qualify for citizenship. I also understand that I need to be careful not to accidentally abandon my LPR.

My question, however, is just about the removal of conditions. Do I need to be physically in the US to do so? Does my husband (US citizen by birth) also need to be in the US? If yes to either of those, is it OK if we just fly back for the ROC process, or does our residence at that time (or indeed anytime prior) actually need to be in the US?

Sorry if that's unclear, I can clarify if needed, appreciate your advice!

You can apply for ROC from abroad, and you will be responsible to return to the US for biometrics and if applicable, and interview.

Requirements for maintaining residency still apply. Good luck.

2/06/13: APPROVED!
