My husband has been in the U.S from september 11, 2009 until now (4 yrs 8 months) when he was 17 and came through the marriage of his mother and a U.S. citezen, who are now divorced. My husband and I got married july 12, 2011 and he now would like to file for me. He hasn't been working or going to school for the past two years, but we do have someone to be or affidavidt of support. What should we do to take the next step?

he should file i-130 for you then in 4 months he should file or citizenship. if you get a visa under his green card before his citizenship is complete fine and good, otherwise you will immediately get one when he becomes a citizen. but start your filing

File I130 under f2a category. Then file for citizenship, 90days prior to his 5yrs in the USA. If he gets his citizenship, then, upgrade your peition to IR1.
