Hello,

i filled my spouse I-130 and got NOA1 in May. I also filed i-129F as soon as i got my NOA1 but didn't hear back from USCIS yet. It been almost 7 month now. I filled many inquiries but same response every time : "Your case is pending consideration". I think my case is less stressful than everyone else since my wife is already here on a B1 visa. However, soon her entry stamp will expire and she will have to go back.

For those of you who filed in May, what's the latest update on your case? do you think i should send a letter to my congressman?

Thanks

I would talk to your congressman. I think most of the May filers got approved in October or November.

Here is the link for the whole NVC process. Read carefully.

http://www.visajourney.com/wiki/index.php/NVC_Process

This is the link to official website: Documents the Applicant Must Submit to the NVC

Once the case number is assigned the process will take about 2.5 to 3 months without checklist. If there is a checklist then it will take longer. Read the above two links carefully to avoid any checklist.

Hey ritbiv,

Thanks for the link. I have read both link very carefully & yes it helped.

But I have some questions & I appreciate if u could help me with it.

What is EP?

They said AOS package is all about petitioner & IV package is all about beneficiary & both packages must send together to NVC but how is it possible. My husband is in abroad and he has all the doc such as police clearance & marriage certificate & he suppose to sign the cover letter & one another document then how is it possible. How would I do that?

Can I send all the (AOS) documents online such as Tax return form from IRS, I 864 & all?

Thanks

EP stands for electronic processing. It is available for Canada and some other countries but not for India. We do not have EP.

The Aos and IV documents are needed to be sent together. You do not need to send any document to NVC. It is beter idea if your husband sends the IV and aos documents together to NVC. As you said all the required documents are already with your husband so I do not see any problem. If your husband does not have any needed documents then you can send that to your husband directly. After that he can send the documents together as per NVC's instruction.

Best of luck!

Only way to know is to call again and try to find out. NVC is getting more slower with each passing day. :( It has been about a month but still my case is not upgraded to IR1/CR1 from F2A. :(

I assumed your husband is the US citizen. It is better for the US citizen to send all the necessary documents to the NVC together. If you are the US Citizen then just follow the above instructions in reverse. :) :)

YEAHHHH

Finally I got case # today by phone & by email.

They told me to fill out DS 261 form & pay the fees & then proceed further.

In the email they have send me list of documents & I had questions about those so I called.

I told rep that I do not have any originals or certified copies & the rep told me that they no longer require originals. I can send them photocopies of all.

I JUST WANT TO MAKE SURE B/C I DO NOT WANT ANY CHECK LIST.

Is it really ok even if I do not have certified copy?

Thanks
