I have a quick question regarding CSPA and its application to an IR-2 petition. I'm a USC petitioning my wife's daughter in the Philippines. We got married before her daughter turned 18. The USCIS priority date is 53 days before her 21st birthday. Does her age start ticking again once the petition is approved, or is it locked in through the duration of NVC processing? If it does start ticking again, is there anything we can do to ensure that she doesn't age out? Thanks!

CSPA freezes the minor's age on the date of filing, so your step-daughter will remain a child for immigration purposes.

Thanks for the reply. I have a quick followup question. Will we need the biological father to sign off on her immigration, or is that a non-issue since she'll technically be over 21 once NVC processing begins?

As you say, since she will legally be an adult, his permission should not be required.
