Hi all, I had a question about AOS and the fee. My wife lives here in Canada with me so has no USA income but we'll still send one in as required. We know it'll get declined, but my step daughter in the USA is going to send one in as the joint sponsor. Do we wait until they reject the one from my wife, then send in my step daughters, or do we send them in together? Also, if we send them separate, is there a second $88 AOS fee?

If you read the wiki that is under Saylin's signature for the NVC process it's quite useful. As the AOS package.. If your wife has no USA income she is still require to fill out an I-864 form, (she's your petitioner), along with the joint sponsor's as well. Read under the AOS package part. Step #4. If your wife lives in Canada with you, she needs to have proof of US domicile in it as well. Which is under step 4. You send it all at once, in one package, one payment of $88!

Um.... I've read the wiki multiple times, but it doesn't mention if the ds261 can become available during the weekends, that's why I asked. (or at least that's what I think) And since it became available today, I confirmed that this can happen on a saturday....

You are already approved, why would you send in anything like that? The NVC is only processing the paperwork for the Visa. If you think you still need it, take it to the interview. Those are the people you need to convince

.both the AOS and IV fees became available to pay on an early Saturday evening for me. It isn't like they are sitting there pushing a button, it is all automated.

I did send in pictures of our wedding and reception and an attestation showing my wife as the sole beneficiary on my retirement account and 401K account.

The thing is at the interview, they already make their minds before even calling the beneficiary to the window!

Also, when filling out the I-864 in part 4 where it asks country of domicile, should she put Canada as that's what it is currently, or should she put something like Canada, but USA upon approval and entry and of course provide letters showing intent to re-establish her domicile there?

IV bill had been taken out of my bank account but still showing in process... Help? I want to fill out the ds260 it's still not available.

If the IV money has been taken out of your bank account, you should send in your 'civil' documents - USPS Express mail. It will show PAID in a couple of days (or more). DS260 should become available anytime now (as soon as your DS261 is approved).

Since I did not send any extra evidence of marriage at the initial I-130 filing ( I had not discovered this wonderful community back then), I included a 20 page 'album' with about 40 pics (really a Word document printout on plain paper stapled together), plus samples of WhatsApp, Tel Logs, Gift receipts, money transfer etc with the IV package. NVC does not need, nor cares about them. But when they send the whole file to Mumbai, hopefully they will take a little time to flip thru' the documents before the interview. I am hoping they will give her back the album.

You are doing something called "middle-loading". This is good practice

Your evidence WILL have to be reviewed by the CO prior to the interview and will have a good POSITIVE IMPACT on the application.

If there's any new evidence that's new (since the i-130) , put that on top of all other evidence.
