Just to make sure I'm understanding this clearly, did your Dad put you as a dependant on his tax returns?

Looks like he did for 2012, and hasn't filed yet for 2013, when Agbcha won't be a dependent anymore.

I don't know what advice to give to you, as it's a bit more complicated than what we dealt with.

From what I know, on the I-864 form, your household member size is only for people who you are financially responsible for. I don't know what advice to really give on this because it's quite complicated as if you listed family within household size on Item number 7, which are non-dependent but people who will be living in the household with you, and combining their income with you. Which usually they file an I-864A, instead of a I-864... But I don't know if it's correct or not.

Me and my wife just used her sister as a joint sponsor, she is only sponsoring me, and my wife is too. My wife hasn't been a dependant on anyone's tax returns though. My wife won't have an income until we move and she finds another job in the states, her sister isn't still responsible for her because we won't even be living in the same household.

I think I'm probably just making this even more complicated now.. Sorry. :jest:

This is weird, my husband was filed as a dependent, he moved back to the US recently and we didn't get checklisted for this. The only difference with your case is that we did not need his mother to file an I-864A as his father's income (joint sponsor) was enough. We added a letter stating why he was filed as a dependent and why he didn't file his taxes (student abroad). It doesn't make sense to me why you got checklisted... :-(

He hasn't filed his taxes for 2013, but when he does I won't be a dependent... I'm not sure if I need to re-do all of the paperwork, because how I had it was:

1. I-864 from me

2. I-864 from my dad

3. I-864A from my mom to supplement my dad's I-864 only, not mine

Do we need to all be household members on all of the forms? Even though I'm living abroad, not with my family? That seems like it would be really confusing for everyone involved

He is a US citizen, lived in the UK, now moved back to the US. I am French, we met in 2010 in the UK and got married in March 2013 in France.

Thank you all so much for your helpful replies. I can't tell you how much it means, because I am panicking about this checklist! Let me get this straight -- if I redo my paperwork, would I do one I864 for me, list all household members, then the I-864A for my parents? I will have to look into it tommorrow when I go to the cyber cafe with the printer, send everything signed by DHL to my parents, have them sign, then fedex it all to the NVC... Is there any way that I could speak with a supervisor to explain and find out for sure how this all needs to be submitted, just in case it's okay to leave it how it is already?

By the way I'm calling the NVC again, fourth time today... I'll say hello for everyone haha

Just checking: you didn't file your taxes right, this is why you were filed as dependent? Did you add an explanation for this?

As you didn't file jointly with your dad I don't see why you should include him in your household, therefore make your parents file the I-864A... But I have read before that you are allowed to do this and in the instructions they say that you can add the person in your household (don't know exacyly where but it is in the I 864 instructions). I would do this but I would also ask for a supervisor review. Your case is so similar to ours that it doesn't make sense why your got checklisted...

I didn't file taxes for 2013, and my parents filed an extension for 2013, so I submitted 2012 as the most recent tax year. On the 2012 return I am listed as dependent, but on the 2013 return I will not be a dependent on my parents' return. I wrote a statement explaining that I wasn't required by the IRS to file taxes for 2013, and that I'm living abroad with my husband. I did not mention anything about how I am listed as a dependent on the 2012 tax transcript, though.

What I found out from looking at the form and from talking to the NVC again is that I need to use them as household members on the I-864A because we all will have the same principal residence when I move back to the US.

Adam, I think, told me that it was a really busy checklist, but that when I see it, I'll understand exactly how they want the paperwork to be done.
