If the father in law is a household member, ie counts your wife as a dependent, then he files the 864a, and you would have your wife list him in Part6/ number 6 and number 11.

If he is not a household member, just a family member, he fills out the regular 864, and your wife does NOT add him to Part 6.

So the scenario depends on whether he is considered a household member... hope that helps!!

I think most people here would tell you to do it without a lawyer as the lawyers have often made errors and aren't as proactive at getting documents out quickly like the members here do. It can certainly be handled by you, with the guidance of this forum :yes::D

NLR, you've even confused me lol, are you suggesting the joint sponsor actually fills out both an 864 AND an 864a by choosing option 3?

Thanks NLR we have been married for last six years and we have a five years old daughter. He was LPR at that time but we applied after his citizenship and never applied for our daughter. He visited me 16 times during six years. I also used to live with his family my daughter is familiar with all of his family members. Have common financial ties since our marriage. I also have multiple visit visa for canada, we and our daughter visited canada twice and recently to SaudiaArabia.Every evidence a normal couple can present we posses all. Are these sufficient for a safe flight from interview?

Yes then they have to prove they live in the same house and that he is her father. So if you choose to go that route, photocopies of both driver's licenses and her birth certificate with him listed.

I-864a is for combining incomes. If she's dependent on his taxes and they do it this way (and he's not married) the house hold is 3. If he's married the household count is 4.

if he files MFJ with his wife she also needs to provide an I-864a.

You are on the right path. If her fathers income meets the requirements then he would file I-864 and

provide W-2s to distinguish his income from anyone else that might be on the Federal Tax Return.

1- my wife's uncle running a shope and her uncle are three family members (husband,wife and a son), and he is the honor of that shope.

So the household count would be 4 in his case, as he will count the family, plus the immigrant.

Most of us here don't use lawyers unless you have a complicated case (waiver or other issues).

If your case is simple, it'll be faster to do it yourself. Friends in VJ will guide and help you if you need help throughout the process.

Study Saylin's wiki in post one of this thread (page 1) and you'll know exactly what needs to get done.

We are also both (well, all three of us) living abroad and personally I would have found it more nerve wracking to worry about the lawyer as well :D You see so many stories here about lawyers messing things up. Especially since we could not have met with the lawyer and would have had to deal with them long distance.

I also had a really bad experience previously with a immigration attorney, so I didn't want to deal with their incompetence again. Not saying all lawyers are incompetent, majority are not I'm sure, but our cases are just one of several cases they're handling and they won't have nearly as much in stake as we do (or time to focus, or interest in our cases etc.), so we have preferred to do it ourselves. It's totally doable from abroad, just follow Saylin's wiki, it has specific info for those filing from abroad.

This was of course our personal decision, everyone makes their own :)

We are abroad as well and have gone through everything without a lawyer.

I do wish there was a section on VJ about filing from abroad (non-DCF) as I've had lots of questions that were hard to find answers within the mix of everything else. I've occasionally PMed old members to ask questions, but of course they never respond as they're long gone. When I get through the process I plan to write a long post about filing from abroad in hopes that it will help someone else!!

Hi! Haven't seen you around in awhile!! You do get an email for case complete. It comes about 7 days after though. And yes, you can always call to ask. I think a few members have reported not receiving that email. So calling just to be sure would be a good idea! It would be awful to have a case complete for weeks and not know it!! Lol!

Yes, read the links in the first post of this thread.

The short answer is that they haven't invoiced it yet. Have you gone to the forms portal and tried to fill in the DS261? If you don't have a lawyer, that's the first step. Of course then, you'll have the even more alarming "this case is in the process of termination" message in the fee portal, which means (it seems) that they're invoicing you.

It takes a few days from case # to be able to do anything on the ceac website. In the meantime, read the NVC wiki so you know what the steps are.
