If the father in law is a household member, ie counts your wife as a dependent, then he files the 864a, and you would have your wife list him in Part6/ number 6 and number 11.

If he is not a household member, just a family member, he fills out the regular 864, and your wife does NOT add him to Part 6.

So the scenario depends on whether he is considered a household member... hope that helps!!

Guys quick question... would you recommend using a immigration lawyer during the NVC stage or is it pretty straight forward and easy. reason I am asking is during the I-130 stage, we used a lawyer and I felt it could have been easily handled by myself.. thanks for your thoughts! :)

I think most people here would tell you to do it without a lawyer as the lawyers have often made errors and aren't as proactive at getting documents out quickly like the members here do. It can certainly be handled by you, with the guidance of this forum :yes::D

Option 3 is the way to go.

NLR, you've even confused me lol, are you suggesting the joint sponsor actually fills out both an 864 AND an 864a by choosing option 3?

Beneficiary - Applying for CR1/IR1 (but also played the K3 card prior to understanding it may be phased out.)

2013: July 20: I-130 sent (Chicago lockbox)

July 24: I-130 NOA1

July 24: I-129F sent (Dallas Lockbox)

Aug 2: I-129F NOA1

Aug 12: Alien Registration Number was changed, I-129F.

2014: Jan 28/29/30: - 3 transfer notices for I-130 and I-129F.

Feb 3 - Hard copy arrived -Notice of transfer to Texas stating Jan 29th.

Feb 10 - NOA2

Feb 27 - email stating I-130 being sent to NVC from TSC.

March 6 -NVC received our case.

April 7 - CASE NUMBER yay! IIN and BIN obtained and email given.

April 9 - DS261 available and filled in online.

April 9 - AOS not yet payable but visible.

April 10 - email regarding NVC case number and access to DS261 received/ email regarding AOS received and paid.

April 11 - AOS sent by snail mail.

April 14 - AOS arrived per mail tracking.

April 15 - IV bill received via email, IV bill paid/ in process, IV package sent.

April 18 - IV bill showing paid/ DS-260 available and done!

- AOS scanned into their system.

April 21 - IV package arrived per mail tracking.

Nope. The Joint sponsor files and I-864 and his spouse an I-864a if applicable.

Unless it's spouses, I never recommend "household" members file an I-864a to combine income. Majority of the time they really aren't household members tax wise.

I doubt it.

Ours only asked for current and planned US occupation. No past work or education. My thought is if they wanted that info they would ask for it in the DS-260.

That's what I figured too and I typed my planned occupation as homemaker, so they probably wouldn't ask about that either.

My esposo did have to fill out past work and school information on the online form. They only asked for addresses, years/dates attended, and degrees awarded. So I would guess they wouldn't be any more specific than that in the interview.

And Happy Mother's Day from us too!

This Mother's Day I wanted to celebrate especially my Mom, though I'm a mommy myself, since I will be leaving her this fall :cry:

I'm def a mama's girl, so moving away from my home country will be real tough for me, even though I've lived in other countries before.

IR1 took 520 days....

Most of us here don't use lawyers unless you have a complicated case (waiver or other issues).

If your case is simple, it'll be faster to do it yourself. Friends in VJ will guide and help you if you need help throughout the process.

Study Saylin's wiki in post one of this thread (page 1) and you'll know exactly what needs to get done.

i have two question regarding AOS package.

1-Yesterday my wife has resubmitted the AOS checklist including her 2013 tax returns,job letter and her uncle (cosponsor) 2013 tax returns papers because she was missed to submit the 2013 tax returns in NVC. my wife income is around 10,000 $ per anum and her uncle income is 20,000$ per anum, and the accumulative income of both of them are around 30,000$ per anum.so it would be enough for one person sponsor?

2.Secondly, she is going to resubmit the AOS package agaisn ,then how much days the NVC take to accept the package, it would be normal 20-25 days or less?? Please advice

1- it should be enough IF the total house hold of your uncle and your wife matches the salary requirements.

Take a look at the attached picture and you'll see.

2- After the mail arrives to NVC, it takes 3 to 5 days to be scanned into the system and then it takes 2 to 3 weeks to be reviewed.

Same question I'll ask do we need a lawyer for our case although we have prepared i130 by ourselves and the lawyer only forwarded our case. I have applied student visa twice just before my marriage. The second time I applied just two weeks before my marriage. I applied tourist visa after six months of my marriage. Everything stated in application was true. But every time they refused. This is only a negative point in my case. I need a good realistic analysis regarding the effect of this negative point in my case. Can it result in a refusal? Should I go for a lawyer? I am v. upset . Please help me vj members.

1) if it is just the uncle, aunt and you as the beneficiary with no children or dependents, then yes, $30000 for 3 people is enough.

2) same amount of time as it takes to originally process the AOS, up to 30 business days.

You don't need a lawyer but you will need convincing evidence that your marriage is not for fraud since you have a history of trying to get to the USA. Two of those were because of wanting to visit your fiance and wife obviously, but it's something to be cautious of.

Thanx, also I decided not to call NVC for my small mistakes on DS260, I'll correct them on the interview, I saw on some treats that's what people received as an answer when called NVC for same reason.

Thanks NLR we have been married for last six years and we have a five years old daughter. He was LPR at that time but we applied after his citizenship and never applied for our daughter. He visited me 16 times during six years. I also used to live with his family my daughter is familiar with all of his family members. Have common financial ties since our marriage. I also have multiple visit visa for canada, we and our daughter visited canada twice and recently to SaudiaArabia.Every evidence a normal couple can present we posses all. Are these sufficient for a safe flight from interview?
