I've been through a lot of stress in my life, but immigration stress and headache are a different story. You know, what's so scary to me is going through all of this and at the end knowing that you can be denied. I know it's rarely, but the thought just scares me. Too much power.

I feel the same way and when they approve you at the Embassy they can still after you pay the plane ticket say well you have to go back. #######!

Going to call on Friday to see if IV has been approved. AOS checklist went very quickly (finally), hoping for similar treatment with IV checklist.

SO I am happy to see your package was received Monday and its already accepted. Did your checklist go to the DR dept? It took 2 weeks for them to accept my AOS the second time but I used the first barcoded coversheet. The package they received yesterday was on the DR barcode sheet. Maybe that makes a difference?

As far as I know, they got denied due to some past criminal issues (on the beneficiary's part). The beneficiary (a Canadian by the way, trying to enter on a K1 visa) said they disclosed it at the embassy, so they knew about it, but the border officer claimed otherwise. So, he ended up getting married to the petitioner and then they filed for an IR-1/CR-1 visa. I believe they were put into AP after the interview, but not sure of the outcome as this was a couple of years ago.

To me, it just sounds like the border officer was a ####### and on a power trip, but obviously, we may not know the whole story.

Ok one more question. After our entry in states can we leave on our green card for a trip somewhere? Or is it not possible to travel for 6 months?

My impression of the rules is that your visa is a temporary green card... you are a permanent resident once you enter.

You don't have to wait to travel; the 6 months refers to how long you can be away without risking your LPR status. Once you pass the POE you could immediately turn around and leave the US if you wanted to.

I personally would prefer to wait until I have the actual green card before I travel, I think, but it's not required.

I replied to the NVC ATTORNEY Checklist reminder just to see what happens; I just told them I already responded and the birth certificate is already here. Delivered May 6, 2014. and this is the auto response I received.. So I guess we can email back !!

Effective September 1, 2013, the DS-260 Immigrant Visa Electronic Application and the DS-261 (Choice of Address and Agent) will replace the paper-based DS-230 Application for Immigrant Visa and Alien Registration (parts I and II) and the DS-3032 (Choice of Address and Agent). Beneficiaries submitting new cases that arrive at the National Visa Center (NVC) from U.S. Citizenship and Immigration Services (USCIS) on or after September 1, 2013 will be instructed to complete the DS-260/261 in lieu of the DS-230/3032.

Cases In Process At NVC:

The DS-260 is not required for beneficiaries of the cases already in process at NVC when the case has already been documentarily complete and ready for scheduling.

The DS-260 is also not required when NVC receives documents that make a case documentarily qualified.

For all other cases in process where NVC sends a checklist for missing documents or information on or after September 1st, NVC will send instructions for beneficiaries to submit the DS-260 along with the missing documents or information, even when the DS-230 is already on file.

For completing the DS-260 form, please visit the website www.immigrantvisas.state.gov and select the link "Establish communication with the NVC and register an address or agent".

Please note that the invoice I.D. Number and Beneficiary I.D. Number are required to access and complete the DS-260. If you or the applicant are unsure of, or no longer have the required I.D. REQUIRED SECURITY INFORMATION:

No need. The attorney is already appointed as the agent when he/she completes and signs the very last section of the I-130 (person other than petitioner preparing the form).

Hi everyone, I haven't had a chance to read the last few pages of comments but I just got off the phone with NVC, I didn't get the girls name but wow, she must be having a terrible day! She had such a snarky attitude. I asked if out case has been received and she said "UH, NO, YOU'RE CASE WAS ONLY SENT A WEEK AGO! IT'S CURRENTLY TAKING 5 WEEKS TO RECEIVE A CASE!" I was like uh wow, 5 weeks, and she said "yes, please don't call back until you are over 5 weeks!!"

Um no! I'm on hold again right now, hopefully I get someone nicer.

This is what it says on the side of the DS-260:

Help: Travel Documentation

Enter the information on the travel document you will be using when traveling to the U.S. Your travel document should be a valid, unexpired passport or other valid, unexpired documentation that is sufficient to establish your identity and nationality.

So I would say yes, enter the beneficiary's passport number, the issued and expiration date of that document.

Ugh, what a b***h! She was so rude! I called back and got Amanda, she was very nice. She also confirmed the 5 weeks to receive it, I know it's BS but annoys me SO much that they still say it! I'm calling back on Monday..

Hi guys! One question! Is it possible that IV fee will be available to be paid before DS261 and AOS fee? This is what my case shows and I haven't seen the DS261 and AOS.

The next step in the Immigrant Visa process is for the applicant to pay the Immigrant Visa Application fee. The principal applicant (or the principal applicants agent) will receive an Immigrant Visa Fee Processing Fee Bill Invoice from the National Visa Center.

Alright, thanks. I guess we will try to schedule our medical date as close to the interview date as possible.

There is no scheduling in mexico. You just show up to the clinic a couple of days before your interview. They give you your results the same or next day latest.

So I have heard, there is also a guy named Arthur and one more guy don't remember his name. Next time just hang up on her it's not worth the stress we are already under. Good call back when ever you need to I'll be darned if I'm going to listen to them when I can call.
