Hi,

First, thanks to everyone on the forum who helped me with my father's I-130 application last year, it's been approved. Now, my boss has asked me to do the green card application for his parents. My boss is an USC and his parents (from China) are currently here on a B2 visa. I have a couple questions:

1) Are there any legal problems for filing for AOS when his parents visits on B2 visa?

2) I think I-130 and I-485 can be filed concurrently from what I've read. However, are there any issues if they are filed separately? I can file the I-130 for him right now but the I-485 needs to wait a bit and his parents are missing a couple pieces of documents.

3) If I-485 is filed, the instructions say to file I-693 medical exam with it. His parents are in their 60's and 70's, but not enough for a waiver based on age. They most likely don't have a complete and authenticated medical record or any medical record at all. What is generally required for the medical exam? The instructions for I-693 says to ask the civil surgeon.

05/22/14 - Electronic Processing OPT-IN, AOS documentations sent electronically

06/16/14 - Case converted to Electronics Processing, GZO case number assigned

06/30/14 - IV fee paid

Filing the 1-130 for them does nothing for their status. The I-485 is what gives them a period of authorized stay while it is being processed.

They will require medical examinations with a civil surgeon. My father-in-law applies for his green card last fall (while he is here) and he had to have the medical exam (he is 70). Some of the vaccinations will be waived due to age but they might need a few.
