No need to take a break, jane. And I'm sorry if you thought I was implying you are a non-person. That was not my intention at all. Please forgive me.

*sigh*

I try all I can to be helpful here and give words of encouragement. Truth be told, there are very few in this community who have any idea the kind of pressure my husband and I are under because of immigration and finances. Now we find the two are impacting the other.

I'm sorry if I took it out on you. That was not my intent.

This is so hard for me to phrase. I want everybody who has come over here to live to be safe, to be secure, and to be protected in their life here. I've probably told this story till people are sick of hearing it, but here it goes again.

At the interview in London, the last thing the CO said - to me the USC - make sure when he gets home with you to get him a social security number and adjust his status.

When we came through Dublin, the CBP officer said very sternly - remember to adjust his status after you are married.

Twice. Twice I was told to take care of this. Twice it was said to ME, the citizen, that I was responsible for it. Responsible for making sure my husband was legal. To not withhold that from him, as sometimes I guess happens with 'sponsors' and 'beneficiaries'.

I'm trying - I'm trying - but they just won't let it happen. I'm trying to help my husband build a life here and at every twist and turn the matter of his status is looming larger and larger. Why doesn't he have his greencard? Why isn't his background check done? Well how much longer will it take?

I'm really starting to worry that his file is just over in a pile somewhere, and that someday, if we slip up - if we let any scrap of interim documentation expire, it we do any one thing wrong - they will have an excuse to refuse his unresolved adjustment of status.

It's killing me.

I knew what you were trying to explain to jane, Rebecca. And no one can blame you for feeling how you feel about your situation - esp. when others don't do things by the book and yet seem to breeze right through everything.

I said you committed a crime and could be deported for that.
Becca, I've never heard of a minor speeding offense, a misdemeanor, being a deportable offense. From what I can see, 8 USC 1252c only allows state and local law enforcement to detain aliens illegally present in the US as well as those who had previously been convicted of a felony and subsequently deported or who left the US after such conviction.

I do not see anything in either case law or statutory law to suggest that alleged speeding makes the person deportable or even detainable for immigration reasons.

(mainly because i am driving a MA plated vehicle and have an ON, CAN driver's license)

Is that even legal?

From the MA DMV:

Who Needs a Massachusetts License?

Residents of Massachusetts (MA) are required to have a valid MA license to legally operate a vehicle in MA.

Out-of-state or foreign-licensed drivers MUST obtain a MA driver's license upon becoming a MA resident.

Out-of-state or foreign-licensed drivers MUST obtain a MA driver's license upon becoming a MA resident.

The argument that it is legal to do so is that the person with the foreign license does not become a state "resident" until and unless state law defines him/her as such. Only state "residents" are entitled to driver's licenses. Therefore, if the alien is not entitled to a state driver's license under state law, he/she is not a "resident." This is not bulletproof but is logical and persuasive (at least in our case, since my wife also drives around with an Ontario license).
