At what point can my fiance receive his social security number? My landlord needs it to run his background check in order for him to live here.

At any point from around two weeks after PoE up until 2 weeks before their I-94 expires, and then at any point from having either an EAD or green card.

A background check on a newly-issued social security number is going to show precisely nothing.

Same place yours came from. Social security office.

Being a bit more helpful, you can go online and find out what is required for your fiance to receive one.

I did need my I-94 and my passport from memory but this link might help.

My wife came to US on Saturday , March 8 and she got her card on the 17 of March. Social Security Office will not accept your application if your I-94 will be expired in 14 days.

New Journey AOS:

My fiancee came to US on the 8th of March, 2014 under K-1 visa at Newark, NJ Airport for POE.

Applied Social Security Number on the 10 of March, 2014.

Married on the 13th of March, 2014.

Sent I-485, I-765, and I-131 on the 15th of March, 2014.

Received EAD on June 7, 2014.

Received Notice of Potential Interview Waiver on July 1, 2014 date 6/27

Contacted Ombudsman on 01/12/2015.

Ombudsman contacted USCIS on 02/20/2015.

Ombudsman sent a follow up to USCIS on 03/18/2015.

I-485 approved on 03/31/2015 ( we ordered your card).

Welcome notice was mailed on 04/01/2015.

Received Welcome Notice on 04/08/2015.

Card was mailed to me/picked up by USPS on 04/08/2015.

Received GC on 4/10/2015.

Tell your landlord that the earliest that your fiance will have his SS card would be 2-3 weeks from arrival, since it would take some time in mailing it, even if I-94 is already electronic. Somebody had even reported in VJ that they were asked by their local SSA to wait for 21 days before they can apply. Also, as mentioned above, tell your landlord that a SS card of a new immigrant will prove / show nothing. Maybe a passport bio page or K-1 visa copy would make more sense, if your landlord just wants to track the people in his property.

All your info is good, but the person that was told to wait 21 days entered with an immigrant visa. They had asked for their SSN to be automatically mailed to them, and the SSA asks them to wait because it can take a bit for their application to go through and their SSN to be processed and mailed. Then, if they do not receive the SSN automatically, they should go ahead and go to the SSA and apply in person. It works slightly different for a K-1 entrant, since someone with a K-1 has to go to the SSA and apply. They cannot get one mailed to them automatically.

I would ask the landlord for their Privacy policy and what they do with the SSN and your other personnel information they collect as that is required by Federal Law. The landlord also does not have a legal reason to request it, you can refuse to give it and the landlord can refuse to rent you the apartment. Does the landlord require all people living in the apartment to be on the lease? A background check is to see if you are a criminal but the landlord should be more interested to see if you are going to skip out on paying the rent. So maybe the landlord will use it to get a copy of your credit report. If that is the case than your fiancé will not have a credit score and then what will the landlord do? It always bothers me when people require something but do not understand why or what it is used for and the limitations. IMHO I would find another place to live.
