K1 Arrival and Social Security Card

Hello everyone.

I have read that once your fiance arrives the first thing you should do is get a SSN, as it is supposed to be easier and a quick name change application after you are married.

I have a form downloaded and filled out. Seeing that she is here on a K1, I did not see the anything listed from the Social Security Administration website that seemed relevant to the paperwork that we have filled out and filed with USCIS. I do not know what papers to take other than her birth certificate, passport and the I-797 approval letter (original).

Can anyone advise on the correct documents to bring with us to the SS office?

her passport with visa, copy of I-94 with at least two weeks left on it, I don't remember needing anything else.

You most likely will not be able to change her name until she gets her green card though.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

You need to bring the form that you filled out and her passport, and I-94.

My wife came to US on Saturday of March 8th, and we applied on March 10. She has her number on March 12, so it was really fast.

New Journey AOS:

My fiancee came to US on the 8th of March, 2014 under K-1 visa at Newark, NJ Airport for POE.

Applied Social Security Number on the 10 of March, 2014.

Married on the 13th of March, 2014.

Sent I-485, I-765, and I-131 on the 15th of March, 2014.

Received EAD on June 7, 2014.

Received Notice of Potential Interview Waiver on July 1, 2014 date 6/27

Contacted Ombudsman on 01/12/2015.

Ombudsman contacted USCIS on 02/20/2015.

Ombudsman sent a follow up to USCIS on 03/18/2015.

I-485 approved on 03/31/2015 ( we ordered your card).

Welcome notice was mailed on 04/01/2015.

Received Welcome Notice on 04/08/2015.

Card was mailed to me/picked up by USPS on 04/08/2015.

Received GC on 4/10/2015.

We researched the I-94 and apparently it was supposed to be attached to her passport at the port of entry.

After flipping through her passport we were only able to find the visa, CFO sticker and certificate. Now I

think were left with petitioning for a lost/missing I-94.

This forum is an amazing resource. Thank you again.

They no longer give a hard copy I-94, you need to get it from the link I posted earlier.

For the K-1, the validity is the 90 days.

The use is it controls your period of legal stay in the USA, when it expires so does your authorized stay status. Staying beyond that date, and you're accruing days of unauthorized stay.

The use is also you must include a copy when you file to adjust status. It proves you entered the country legally, as opposed to entering without inspection, which is illegal.

A common misconception of K-1 entrants is if they get married, they're legally in the USA. But in reality they are not legally in the USA beyond the date in the I-94. They regain authorized stay status when they get the NOA1 to adjust status. They become a legal permanent resident when they get the green card.

A large percentage of K-1 entrants, have some period of time in unauthorized stay status. As its not easy to both get married and get the AOS filed in just 90 days. But as they're married to a USC, these unauthorized stay days are forgiven when they get their green card.

That's pretty fast to get married. My wife and I got married 5 weeks after her arrival. Four weeks after that her AOS paperwork was in the mail. So we definitely got ours in before her I-90 expired. It would have been in faster, but I spent a bit more than I expect on the wedding and had to recoup enough money.

The guides here are pretty for getting the AOS done right.
