How old is your brother?

Anyway, I doubt there's a shortage of graphic artists in the US. Before you can hire a foreigner, you have to prove that there's no other person (USC or LPR) that can do the job.

You have to prove that you can't find a US citizen to do the job. (Unlikely, there's a great many graphic artists out there looking for work.)

If, by some chance you do, you will likely need a lawyer to assist with the visa and many thousands of dollars as is usual for work visas.

Doesn't sound credible to me. There are tons of graphic artists in the U.S. Sounds like you're looking for an excuse. It won't work.

There might be tons of graphic artist in the US and we will be looking at tons of PF as well. I am looking for an option here not an excuse.

No idea what a 'PF' is.

As has been said, you won't be able to successfully get him a visa to work in the U.S., there are others who can do the job, and that's the criteria.

You can employ him remotely, that is often done. He could deliver his work online.

Good luck.

You can try Jon and Sol's advice.

If all else fails, once mother becomes LPR she can file for your brother (assuming brother is unmarried).

Hi,

Absolutely no chance of getting a US work visa when there are alternatives.

Alternative 1. Hire a US graphic designer. Plenty who can do the work.

Alternative 2. Online. Brother does not need to be in the US to design for you. He can email his work to you.

Sorry.

There is a way, at least for him to work temporarily.

If he graduates from a U.S. school with at least a bachelor's degree in a related field (e.g. multimedia), he'll be eligible for Optional Practical Training (OPT). OPT is a one year work permit which allows graduates from U.S. colleges and universities to work in the US for one year in a field related to their major. He could work on OPT full-time after he graduates, or part-time while school is in session.

He'll have to be a full-time student at an accredited U.S. school, and his major has to be relatable to graphic design without insulting the intelligence of te USCIS.

In addition, it looks like your mother is getting close to immigrating. Is your brother under 21 and unmarried? If so, she can petition for him as her immediate relative and the process is fairly quick. If not, you could always petition as his sister, but from the Philippines, you're looking at a 20 year project.

Please be careful with your terminology.

"Immediate Relative" has a very specific as legal meaning in immigration. An "Immediate Relative" is either a spouse, parent, or unmarried child under age 21 of a US citizen.

As an LPR, mom can petition for her unmarried children. She does so in the family preference categories. The process is not "fairly quick" unless you consider 2-3 years where the brother would age out into the F2b category where it's 10 years for a visa.

Seems to me to be the best and perfectly acceptable solution in this case.
