List of documents to file with AOS

Hi, Guys!

After reading guides on AOS on VJ I want to make sure that all the docs are correct when we file:

1. G-1125 (optional)

2. G-325A (do i indicate my husbands' last name if i took it?)

3. I-485

4. I-131

5. I-765

6. I-864

7. I-693

8. Payment 1070 USD

9. 2 passport style pictures

10. Passport copy

11. Copy of K-1 visa

12. Copy of NOA2 (from K-1 process)

13. I-94 printed from web

14. Copy of birth certificate + translation into English

15. Copy of marriage cerficate (certified at the Court house)

16. Copy of my husbands divorce papers ???? - Is this needed???

17. Documents that prove financial support for I-864.

18. Other prove of marriage: photos from wedding, receipts where both our names are shown, letters that came on both our names etc.

When filling all forms I should put my surname after marriage, is it correct?

All the forms are related only to me as a person applying for AOS? - i mean when we did K-1 we were putting on the main form my husbands name, now the main form for AOS is I-485, so I assume all info is related to me only?

Any other comments or observations are welcome!

You do not need to include any evidence of marriage/relationship with your AOS paperwork, other than a copy of your marriage certificate.

Yes, if you took your husband's name when you married, then use your new married name on all the AOS forms.

Do I understand correcrtly:

2 passport style photos for - AOS

than 2 passport style photos for I-765 and 2 photos for I-131 ???? In total i should add 6 passport style photos if i ship all papers at the same time?

As for I-765 and I-131 (in my list i had included copy of my passport and K-1 visa and I-94 as supporting docs) - should I separate these docs when filing for AOS? - i mean i sort them separately in a folder?

the payment of 1070 USD - which includes biometrics go in the same check, right? - i mean no need to separate biometrics from AOS sum?

Yes, you would need 6 photos total. Make duplicate copies of any evidence that is required for more than one form. They do not need a separate folder, but just put each form and its supporting documents together, maybe with a large paperclip, and stack them all on top of each other. List what is included in your cover letter in the order in which you stacked them together.

thank you! last question about affidavit of support.....

for K-1 my by than fiance was presenting his pay-stubs (monthly for the last year) and no w2 or tax returns as far as he is not a subject for taxation in the USA (he is military man who was medically retired, so they do not pay any taxes it´s foreseen by IRS).

so, my question is: can we provide his pay stubs as a prove of his income as we did for K-1? (i ask cos in affidavit of support for AOS they ask for tax-returns for 3 years if i am not mistaken). as for the income, we are a family of 3 and income is more than 40K per year, so we are way good as for poverty line...

He needs to provide a statement as to why he was not legally required to file taxes for any or all of the last 3 years. He can even get a letter of not filing, if he wants to include it with his explanation statement > http://www.irs.gov/Individuals/Get-Transcript

Provide the pay stubs and perhaps a few months of bank statements showing the actual amounts being deposited each month, since he has no tax returns to prove he received the income. Does he receive a 1099 of some kind each year that shows how much he received annually? If so, include that or some other document that shows his benefits/income amount.
