Hi everyone! I'm currently working on the papers for AOS with my husband and we're almost done. All we need is to fill out the I-864. I just got a new job, and I know that my income alone is insufficient to provide sponsorship. We are currently living with my father (not biologically; he's my stepfather but he and my mother are divorced... for all intents and purposes he's my father). I have a few questions so I guess I'll just list them in order.

1. My official state of residency and address is in Pennsylvania at my mother's house, but my husband and I are living in Delaware now with the pops. I still have mail sent to PA though, and my ID has my PA address, and my social security info has my PA address. We also used the PA address for my husband when applying for his K1 visa and for all purposes thereafter. Even though we're not actually living there, will there be a problem if we continue to write that as our address on the forms for AOS? I don't want to get into the whole change of address thing until after we've gotten the green card, if we can avoid it.

2. My father is going to be a joint sponsor for the I-864. I know I have to fill out my own, but I'm stumped as to what to check off in part 1 number 1. Which box do I check?

3. Which box does my father check? I'm assuming he has to fill out his own I-864 but correct me if I'm wrong.

4. Will it be confusing if I write my mailing address as the DE address on this form but none of the others? Only because that's my father's address and we're technically in the same household, so I don't know how that affects the form filling. Or should I just continue to write my husband's and my address as the one in PA?

5. What supporting documentation should I send? I'm 19 and did not file tax returns last year (or previous years). I plan on doing so this year because I just got a new job in February. Before our marriage in November I was living outside of the US and working on the Internet, until I got an internship in Sweden. Anyway, the point is I have no W2s to submit for 2013. What all should I send to prove my income now?

6. What supporting documentation should my father send? He was the sole sponsor on the K1 visa, so should he just send all the same things that he did before?

Thanks for your help. I can't wait until this is all taken care of!

I literally just noticed this. Part 4 has separate columns for mailing address and place of residence. Can I put my mailing address as the DE address, and my place of residence as the PA address? Or should I just leave it alone so as to avoid confusion (and put both as the PA address)?

Check out form i-864 A - contract between sponsor and household member.

However, filing this form would mean you live in DE with your dad and not in PA with your mom.

You would fill out form i-864 and your dad would fill out form i-864A - please refer to page 13 of i-864 instructions for a check list.

If you want to keep your PA address you and your dad both need to fill out seperate i-864 forms.

As far as everything else, again refer to the instructions! Read it word for word and fill out your form as you go along.

For instance you are having trouble figuring out what box you should check off for part 1. It is clearly explained in the insturctions.

Good luck!

< You need to list your residence, as in where you are currently residing as your residential address. You can use the PA address as your mailing address, but it seems silly to have your mail sent to another state, and your local USCIS office will depend on your residential address. You will need to go for a biometrics appointment and possibly an interview at your local USCIS office, so you do not want them sending you all the way to PA. Use your current address for all the AOS forms.

<--You check 1a. and your father checks off 1d.

4. Will it be confusing if I write my mailing address as the DE address on this form but none of the others? Only because that's my father's address and we're technically in the same household, so I don't know how that affects the form filling. Or should I just continue to write my husband's and my address as the one in PA? <--You both use the address where you currently reside, which is DE.

<-- Provide a statement as to why you were not legally required to file taxes for the last 3 years. Provide letter from employer and/or recent pay stubs to prove current income.

6. What supporting documentation should my father send? He was the sole sponsor on the K1 visa, so should he just send all the same things that he did before? <--Needs to list last 3 years Total Income from his taxes on the I-864 itself and provide his 2013 tax transcript, letter from employer and/or recent pay stubs, plus proof he is a USC or LPR.

I suggest you read through the I-864 form instructions > http://www.uscis.gov/sites/default/files/files/form/i-864instr.pdf
