US Permanent Resident applying for college financial aid

My wife will be a permanent US Resident and she wants to attend college.

In regards to the terms of the I-864 9 (Affidavit of Support)……..Is applying for and getting college financial aid considered a form of welfare or public assistance? Would this violate the terms of the I-864?

Hi,

College financial aid is not a means tested benefit.

An LPR is allowed to get college financial aid.

College financial aid has nothing to do with the I-864.

Your wife can use financial aid.

Be careful of residency requirements for in-state tuition. Some school requires a student to be an in-state resident for 1 year before that person can qualify for in-state tuition. Some schools allows the student to use the spouse's residency under certain circumstances. It's school specific, so you will want to check with each school about this.
