So, as you will know from previous forum posts, I was refused a K1 visa back in late January/early February.

Today, I received an email from the US Embassy in London which stated "Needs Follow-up Docs." I read through it and apparently I have to DX them my passport and an US-size passport photo.

My negative side says that it's so they can stamp a big, red 'Refused' rubber stamp on my passport. Yet my positive side says "Come on, this means you're still in with a chance of moving to be with the one you love, right?"

When I went to London for the, very short, interview, the CO handed me back my passport and police certificate, but they hadn't stamped my passport with refused. I guess this is why I'm thinking that they had a "oops, forgot to stamp it, can we have it back please?" moment.

So which side do I listen to? Am I right to remain positive? The CEAC page still states refused. But maybe they've looked deeper into the case, realised that I'm not a bad person and that they will ultimately let me into the country to be with my fiancee?

Has anyone here had this experience previously and what was the outcome for you?

What is the story behind refusal? Did they request any additional documentation from you?

I don't believe that they will stamp a refusal in your passport, they will just note it in the system.

-Jan 24th, 2014 sent in I-129F

-Jan 31ist, 2014 received NOA1 via text/email. Arrived at CSC

-Feb 4th, 2014 received Alien registration number.

-Feb 24th, 2014 received NOA2

-Mar 12, 2014 Arrived at Embassy

-Mar 20, 2014 Packet 3 sent to Embassy

-Mar 28, 2014 Received packet 3 instructions in mail

-Mar 25, 2014 Interview date set

-Apr 4, 2014 Interview.. approved :dancing:

-May 21, 2014 - PoE LV NV

-May 30, 2014 - Married

The back-story is documented in my other posts from earlier this year. At the time I was told by the CO that the visa was refused and that I would not be entitled to a waiver.

But if they've already seen my passport, finished the interview, etc. surely they would have put it in the system then? They wouldn't need my passport and another picture again (when they already have the information from it, taken when I was at the Embassy).

There is a contact form to email the embassy. http://london.usembassy.gov/niv/visa_contact_form.html

Use it to get clarification. Tell them you were told on [date] that the K1 visa was denied. You thought the case was closed. You want to ask why they are requesting your passport and a photo when you no longer have an open visa case.

It could be an email sent to the wrong person. They have made errors in the past. Follow up with the contact form and get the answer from the source.
