How to get work visa for USA to work at Subway Franchise

I’m an unmarried male, Indian Citizen, 34 years of age, staying in India. I wish to move to USA for employment/ Immigration.

My very close relative, an American citizen owns a Subway Franchise in USA.

One of my Friend who is also an American citizen, owns a Subway Franchise in USA, shared with me that he had called one of his relative from India to work at his Subway under some Visa (I guess work Visa).

Can somebody guide me about the process and the steps involved for my close relative to call me to the US to work in his Subway?

There are no work visas to work at Subway. Plenty of Americans can do that job; no need to find others.

That other guy is working illegally.

I assume you simply mean to be a sandwich maker correct? that is not skilled labour and will not be issued a work visa for that type of job.

Sorry, but it sounds, from what you post, that your friend is working illegally

Stop Guessing.

Call the Friend back, use a telephone,

and ask him to email you a scan of the VISA that was issued to his relative,

then

post the scan here,so that we can help you vette things.

Ooooooh... I just realized... They are sandwich "artists" so maybe a special artist/fine arts visa catagory?

Could it not be done through the EB-3 visa? it says there is a part for unskilled workers, thats what he could be referring to?

If your relative is your parent, adult child, sibling or spouse, you they can petition for you to immigrate to the US.

If your relative is not one of those our categories, you cannot immigrate based on your relation to him.

If you want to work legally in the US, you'll need a work visa. No work visa will allow you to work an unskilled job at Subway. If your friend is a sandwich maker, or working any other unskilled job, he likely arrived in the US on a tourist visa, and is working illegally. Once caught, he'll be deported from the US and banned from re-entry for a period of up to ten years.

So what work visas are available? A few. The most common is H1b. An H1b visa requires your prospective employer to sponsor you. The job has to require at least a bachelor's degree or higher in a specialized field. Unless you're working a position high up in Subway corporate, an H1b is unlikely.

If you want to immigrate to the US for work, you'll need:

1. A (mostly) clean criminal record.

2. A (mostly) clean immigration record.

and either A + B, or C

A. At least a bachelor's degree in a specialized field.

B. A company willing to sponsor you for a job in a position requiring the above.

C. An immediate relative (spouse, parent, adult child, sibling) US citizen willing to sponsor you. (Can be green card holder if the relative is your parent or spouse)

There is another option. You could invest in, and open your own business in the US. This will have to be done with your own money.

Which part of working in Subway is so specialized that they can't get qualified workers in USA?

The basic requirements for the EB-3 "Unskilled Workers"" category are as follows:

FIRST: you must be capable of performing unskilled labor;

SECOND: you must have a U.S. employer who is offering you a full time job involving unskilled labor which is NOT on the Labor Department's "Schedule B"; and

THIRD: your employer must obtain a LABOR CERTIFICATION (PERM) on your behalf for the job position.

One of the requirements for bringing over a foreign worker is that the employer cannot find a qualified US worker.

Do you think there is a shortage of people who can't make sandwiches in the US and there is a need for a foreign worker?

The guide to this is a very quick and easy read on account of there isn't one, since there is no work visa category for the much in-demand skill of placing meat and cheese on bread.
