Ok, get this...

Hubby gets his CR-1 visa on 8/19/05. We were married less than 2 years at the time. When he finally got his green card, he got a Permanent Resident Card with an expiration date of 10/21/2015 and says it's an IR-1. I finally called USCIS today. The guy said that in his records, it's not a mistake, that he really has Permanent Residency (IR-1) and that the expiration date is correct.

Has ANYONE ever heard of this??? I asked the guy several times to make sure. The customer service guy said that for whatever reason, they decided to give us the IR-1. I think it must be pretty rare. Hubby thinks it must happen all the time.

Is there anyone out there who also had this happen? Or is this the miracle I think it is???

Thanks for your responses!

shayneandshelley,

What is the date of your marriage? What is the date that your husband entered the USA?

If the dates are more than 2 years apart, your husband correctly got LPR status without conditions (IR-1) on the date that he entered.

Married 3/22/04, he entered the US the day after the interview in Montreal, on 8/19/05.

I was almost afraid to post this, but then I remembered....I called USCIS to confirm it!

Thanks for the reply :)

shayneandshelley,

I would nevertheless submit and I-751 during the 90-day period prior to 8/19/2007. If a mistake has been made, your husband is not absolved of paying the consequences if and when the mistake is discovered.

When I turn up at the POE clutching my full immigrant visa, should I point out to the Officer that we have been married 2 years and one day and we would expect the ir-1 unconditional green card and can he put a note on the file- or can't he put notes on it ? ie is it up to the hormones/hangover of the person who eventually issues the green card as to the period of the card (and what permutations of the name they use) ?

My last name is 4 letters long and a very common one (4 people in my university class had the same name), and with no alternative way to spell it - they still got it wrong when I entered with K1 and caused a SS card issuance problem....
