hello all, its my first time getting into this forum,,i thought life is pink lol,,,any way,my marriage is so unstable coz my wife is really unstable person psychologically,,she is not crazy but unstable,upon a regular argument she filed divorce,left the house and now she came to me to say she wants to come back,,i told her what about filing divorce??she said it will not go on as she wont show up in court to continue it!!!!! is that true??? or she lies??

now ,im not sure this relation will go better,,coz of threats all time of divorce,,so ,a friend told me to do waiver based on divorce to get a permenant green card,,and said I have to own enough proof that I entered the marriage in good faith which is true,,my proofs are:

-joint tax return for 2013

-joint bank account.

- proof I came from far state by car to be with her-after she asked me to leave.

-membership in our both names

-phone bill paid from her account and the phone is under my name

-her ID and driver lic with last name of me

-pictures of me and her and her family and her with my family

-post cards she sent me and mails I sent her,plus us texting all time

-

I don have lease or utility bills as she has the place before I came and refuse to put my name with her although I pay.

so now is that enough,,we almost married for 2 years and im in states for 6 months now

I can't comment on your waiver proof, but if your wife really did file for divorce then you should have been officially "served" by mail or in person a Summons and a copy of her court filed Petition. You would then file a Response or risk having her get the divorce by default. She no longer wants a divorce? If no Response has been filed and no Judgement has been obtained, the case can be dismissed if Petitioner alone files a Dismissal form.

How will you remove conditions with a divorce waiver if you're not actually divorced?

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

someone called me by phone saying he from court ,I called back ,and no answer,but nothing more,u mean she must file to dismiss it?

Can you get proof she is unstable? That I think would pretty much do it, would be to your benefit to ask a lawyer about this. Does she take medication and texts might show she is not well. I'm sorry but she seems a little bit nuts to me. Don't mean to offend but who can live like that all the time, I think if you have proof they would side with you. Good luck.

Yes, the court is not going to make a phone call, she needs to see he gets served the divorce papers. A phone call cannot serve papers.

well,she take heart medication ,makes her moody,based on her saying,,and I guess some hyperactivity meds,too much pain killer,,i have some texts saying that its her heart med,,im in living hell,,i lost 30 pounds since I came here???so far no talking about dropping divorce,,i started to have life here,,study ,job,,but she hates me going to do anything and fights over it(gym,work,school)etc,,any ways I not hate her ,I feel sorry for her but she acts like 5 y kid who wants attention all time..so I say if im divorced anytime soon ,,will that b enough proof for ROC? ON MY OWN?
