i went here in US under fiance visa that expire last april 21, we did get married already but then havent adjust my status yet, is there anything gona hapen if i decided to stay in other place? what should the best way to do

Where is "other place" and will it be with your husband or are you planning on going to this other place on your own? As you should know you can only adjust status from K1 with the petitioner.

What exactly do you mean? "i" [sic] as in you - without your husband?

Are you wanting to live somewhere without your husband? Please explain so you can get the proper answer(s).

Your visa expired the second you cleared POE , your validity for being her now is the I-94 which is good for 90 days from POE date. You are not out of status until that 90 days has expired, so if you travel about the USA for sure carry your passport and also go to the CBP website and print out your I-94 (save a copy to your computer as well.

Best thing to do is adjust status.

You are currently out of status. Anywhere in the US, you can be detained by ICE.

She is not out of status, her I-94 is good for 90 days from POE date. Until the I-94 expires all is good.

She is not out of status, her I-94 is good for 90 days from POE date. Until the I-94 expires all is good.

By the wording of the original post it sounds like she entered the US around about January LAST YEAR so that would maker out of status now.

That's assuming that by saying her K1 visa expired last April she was referring to her 90 days after entry.

Unless of course she means that it expired on Monday

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

Yes they say "last" for things differently then we do, it most likely was last week in this case. English is a second language.

Their timeline shows the visa was not received until 24 January, 2014, then it shows entering the USA the year before.... typo is my guess judging by the rest of their timeline, so I would say POE was the start of February 2014

hello everyone thanks for the reply.. sorry i did make all of u confuse just feeling bad yesterday and its like i wana go in other place( yup other place is still here in the US thats what i mean like visiting my relatives but they were too far from where i am right now so i wanna know if its fine .. my port of entry was in detroit but then they never give me a I-94 and thy never say anything bout it... but i did try to research on about I-94 so am i gona do it online and print it out

As lont as you have the right papers as Hank recommended you can go anywhere in the United States you like. Just don't leave the United States until you get either your Green Card or your Advance Parole document.

Be sure to marry within the 90 days and file for AOS/AP/EAD. Once you do that you are good to continue to move about in the United States as you please. But still don't leave until you have the actual granted Green Card or AP document because you will need one of those to get back in.

You can move or visit anywhere within the USA. You cannot adjust your status on your own or with anyone else but your husband. All in all when your I-94 expires (90 days from your entry to the USA) you will be out of status and in the USA illegally.

There is a rather good size Filipino population in Florida, depending on where you live. Search for the local Fil-Am association nearest to your location.

You can travel anywhere within the US. You will need AP(which you apply for when you file for AOS) or your green card to be able to travel outside the US and re-enter without abandoning your AOS process.
