Hi everyone

I have just been through a terrible experience trying to visit my girl friend who I haven't seem in January. I got denied entry into the united states and I was unsuccseful in a B-2 visa application.

I'm a U.K. citizen wanting to marry my U.S. citizen girl friend/future fiancee/future wife

This is basically my journey of myself and my girl friend/future fiancee/future wife

June 1st 2013 - September 9th 2013

I worked at stagedoor manor performing arts theater camp as a Lifeguard & videographer. I worked there with my J-1 visa and went through everything correctly with no problems. I then met my now girl friend/future fiancee/future wife.

September 9th 2013 - December 20th 2013

I went back to my home country in the U.K. and worked at Cit Lit theater company in London U.K.

December 20th 2013 - January 18th 2014

I went to visit my girl friend for christmas and met all of her extended family. As well as spend my birthday with my girl friend

January 18th 2014 - April 12th 2014

I was looking for work and finally found a job at the Cliffs Pavillion in Essex U.K.

April 12th 2014

I took a flight from London Heathrow to Boston Logan International. I was visiting my girl friend and going to her friends wedding with the wedding being on June 1st, staying for 2 months before I started to work for the Cliffs Pavillion in Essex U.K. I was waiting for my suitcase and guitar and once I found my guitar and started to move on I got stoped by a CBP officer with my bags checked. She asks me the same questions over and over and over and over again of "Where are you staying, How much money do you have, Why are you traviling" I told her I was traveling to the U.S. to visit my girl friend like i've done before. I told her how much money i had and she said That seems a bit low for 2 months, even when i explained I have my girl friends apartment that ill be staying in along with my parents toping up my travel card regualry. Also not to mention i was about to get paid from my trial shift at work that I had before I flew out.

I told her she could call my girl friend if she wants. She took my phone and called her in the other room. She came back and told me flat out "I just talked to melissa and she says your getting paid $200 a week." which was news to me and confused me very much so because A. I wasn't getting paid & B. why would melissa say that. The office continued talking acting like it was fine saying "Yh this will compensate you while your here right?" Still confused by all of this I kept saying this is news for me and was waiting for ages again. Keep in mind once I talked to my girl friend on skype when I got back to the U.K they said they grilled her the same questions too and she didn't once say that I was getting paid.

I was then asked questioned in a report. Now I was scared through out, didn't understand what was wrong and terrified that I wouldn't see my girl friend for reasons of they didn't trust me and they thought I had low fund and started to panic. Then when they asked me how much are you getting paid I said "$200 a week" which Is what melissa my girl friend gets paid and then they asked by cash or cheque? i said "maybe by cheque" so they basically got me to tell a false lie and denied my entry. With all this being said I cried tremendiously and was told by the CBP officers everythings gonna be ok You can apply and get a visitors visa b-2 and you can come back within 2 days.

So I wasn't banned from the United States I was just denied entry and can only enter the united states based on a visa. They flew me back home.

April 25th 2014

During the 2 weeks since everything happened I booked an appointment with the US embassy in the U.K. and when I went there everything that was a problem with me visiting my girl friend crept up here. I told the CBP office when I was denied entry my monthly salary is £5,000 a month but i've just started working there and only worked a trial shift. They wanted a pay slip from my work when I haven't got paid yet and that wasn't asked for in the application process I applied for online. Then they took one look at the report that happened when I got denied and I was an unsuccessful candidate for not having strong enough ties to the United States in there eyes.

Present Day

Now i'm 23 going on 24 & my girl friend/future fiance/future wife is 24 going on 25.

We talked about everything that has happened and shes going to Visit me when she can. Which will only be for short periods because of her line of work as a scienic artist in theater. But we also want to do the K-1 application

Now after all of that long winded information on myself and my girls current situatuion

Will My denied entry to the United States and unsuccessful visitor visa application hurt our chances of me living in the U.S. with my future wife in our K-1 visa process

Sorry to hear about your customs visit. My fiance has been here to visit me a total of three times. Two of which he was pulled into Secondary (almost denied entry). But they never asked him about how much money he was bringing. They were just paranoid that he was going to stay here on VWP. Luckily enough I'm good at talking to Customs Officers and he got through every time.

I do know on some of the forms it will ask if you have ever been denied entry into the United States. I don't think this will make you "ineligible" however. If I were you I would hire a lawyer so you have someone to fight for you if the opposing party makes a racket about it.

You don't need a lawyer for this. Being denied entry and a B-2 for not having enough strong ties to your country will not affect your eligibility for a K-1.

I second this!

I was denied B-2 visa back in 2010. We did not hire a lawyer and got approval for I-129F in 38 days without RFE and visa in hand in 143 days. Some member here who hired " so called smart and very communicative lawyer" ended up getting RFE. :rolleyes: . I guess a lawyer is not guarantee you anything at all.

Hi, you don't need a lawyer unless you're dealing with bans/waivers/misrepresentation issues. If it was a straight-up denial of entry and denial of B2 for lack of ties, you're good to go without the lawyer. They can't deny a K-1 for lack of ties to the UK since the purpose of the K-1 is to leave the UK forever :P

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.

March 14th 2018: Submitted service request due to being outside of processing time.

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

A denied B-2 visa will not affect a K-1 visa application. Lawyers have a history to people on this forum of messing up their application and causing RFEs or worse. This is a heavy DIY website and you'll be hard pushed to find someone who would recommend a lawyer.

Sounds to me like they saw your baggage, including musical instrument, and thought you were coming here to work in the VWP, which is illegal. Then they grilled you up and you fed into their false assumption based on the story they made up about the phone call. That's a rough break. Unfortunately now you're ineligible to ever use VWP again and will have a rough time getting a B-2.

The good news is, you can still apply for a K-1 and will likely get it approved. The VWP episode may warrant some questions, but ultimately I think you'll be ok.

Being denied a visitor visa because they thought you had immigrant intent has no effect on an application for immigration (k1) because of course you have immigrant intent now... No worries...

Sounds to me like they saw your baggage, including musical instrument, and thought you were coming here to work in the VWP, which is illegal. Then they grilled you up and you fed into their false assumption based on the story they made up about the phone call. That's a rough break. Unfortunately now you're ineligible to ever use VWP again and will have a rough time getting a B-2.

The good news is, you can still apply for a K-1 and will likely get it approved. The VWP episode may warrant some questions, but ultimately I think you'll be ok.

When I read the post I said exactly the same thing to my husband. CBP saw the guitar and assumed OP was in America to do some sneaky work on the side.

OP, this was so unfortunate.

When I dated my (now) husband I flew out a lot in the space of a few month:

11th Feb 2012 - 2 weeks

1st June 2012 - 90 days

30th November 2012 - 90 days

I admit I had heard all the horror stories of being denied entry so I always carried with me my employment contract, a letter from work, pay slips, bank statements and my tenancy lease. I would say a prayer every time before I went though the immigration line LOL.

I was never really grilled much other than being asked what I did during my previous stay and if I had anything nice planned for my current trip etc..

The good news for you Is this experience will not affect your K-1 application.

Everything will work out ok.

These officers have very strange strategies. I got stopped by them over a month ago when I was trying to come to America to visit my fiance. Ive never had problems with entrance before but they stopped me this time and kept me there for hours... I was scared they will send me back home. I had previously stayed here for the amount of eight months during one year (two months here, went back home for two months, got back here for six months) and that's why they stopped me. He thought I worked here cause it was hard for him to believe that I was "free loading" for this many months. But it was true, my fiance provided everything for me and when the officer called him, my fiance confirmed all this. So they let me in but only allowed me to stay here for two months, which worked out perfectly since we just got approved and I'll be home in a month to finish the k1 visa process. But yeah their strategy is weird cause he was trying to make me admit stuff, he was like "I know what you did. Where did you work?", asked me that a few times. I told the truth every time and everything turned out to be okay. I'm glad that didn't affect our fiance visa petition.

Only weird thing that ever happened to me was my second time going to the States, I was pulled aside and had my suitcase "searched". And by "searched", I mean he pulled a book and a shirt out, asked what my visit was for, then let me go. Ironically, I did actually have syringes and needles in my suitcase, but they were full of heparin, not heroin :D Otherwise, I never had much trouble gaining entry. The guitar was the most likely thing that set them off, they might have thought he was going to do some busking.

I think you have to prove you met your girlfriend two years prior you send the K1 application, so, if you met in June/2013, you need to wait.

Also, are you subject to the 2 years home residence requirement, since you worked here on a J1 visa? Check is on your DS2019.
