First of all, I want to say a big thanks to VJ because it has helped me immersely with my adjustment of status.

Now my question regarding joint sponsor for I-864:

I have gotten a joint sponsor to prepare me an affidavit but he is married and file jointly with his wife for 2013 tax return.

He has decided to serve as a joint sponsor independently without his wife.

My question is, can he fill out form I-864 without his wife filling out I-864A? He makes enough money to serve as a sponsor independently and was wondering if it's compulsory for his wife to fill out I-864.

Any response will be appreciated!!! Thank you all

Yes he can, he just needs to only specify his income on the I864 but count any household members in the household size, supply a copy of his transcript and his W2's quantifying his income.

Make sure to provide proof of his individual income by providing a copy of his W-2 along with their joint tax transcript, a letter from his employer and/or recent pay stubs for him.

Can his 2014 w-2 and the most recent joint tax return be sufficient because the Intruction on the I-864 says most recent tax return must be submitted or I need to get a tax transcript?

Instead of a transcript, you can send a complete copy of the return. A complete copy is all forms, schedules, attachments, W-2s and/or 1099s. Basically anything you would have to fill out and send to the IRS to file by mail. You need the 2013 W-2 to go along with the 2013 tax return. There is no 2014 W-2 as of yet.

The IRS transcript alone covers all of that, so you would only need the transcript and the W-2 to show the separate individual income. Transcripts can be printed > http://www.irs.gov/Individuals/Get-Transcript
