Help Regurding Leaving US

hello all

Right Now i'm <the petitioner> in the states i applied for my husband<the benificiary> who is in india right now

now my question is as we were married on 21st January 2014 in india.

i leave india on 18th feb. our file is routed to vermont service center. now we r in waiting period.

i filed my tax returns for 2013-2014.

now i think to move india and live togther till my husband got visa.

is this possible for me to leave states now till my husband got visa?

If you leave the states and move to India, will you still have a house in the US? A job waiting for you? You have to prove domicile. If you can't prove domicile, he will be refused. Also, if you can't prove your current US income, at the time of interview, is 125% of the poverty line for your household size or that you have sufficient assets (I believe the number there is either 5 or 3 times 125% of the poverty line, but I'm not certain), then you will have to have a cosponsor.

Met in 2010 on a forum for a mutual interest. Became friends.
2011: Realized we needed to evaluate our status as friends when we realized we were talking about raising children together.

2011/2012: Decided we were a couple sometime in, but no possibility of being together due to being same sex couple.

June 26, 2013: DOMA overturned. American married couples ALL have the same federal rights at last! We can be a family!

June-September, 2013: Discussion about being together begins.

November 13, 2013: Meet in person to see if this could work. It's perfect. We plan to elope to Boston, MA.

March 13, 2014 Married!

May 9, 2014: Petition mailed to USCIS

May 12, 2014: NOA1.
October 27, 2014: NOA2. (5 months, 2 weeks, 1 day after NOA1)
October 31, 2014: USCIS ships file to NVC (five days after NOA2) Happy Halloween for us!

November 18, 2014: NVC receives our case (22 days after NOA2)

December 17, 2014: NVC generates case number (50 days after NOA2)

December 19, 2014: Receive AOS bill, DS-261. Submit DS-261 (52 days after NOA2)

December 20, 2014: Pay AOS Fee

January 7, 2015: Receive, pay IV Fee

January 10, 2015: Complete DS-260

January 11, 2015: Send AOS package and Civil Documents
March 23, 2015: Case Complete at NVC. (70 days from when they received docs to CC)

May 6, 2015: Interview at Montréal APPROVED!

May 11, 2015: Visa in hand! One year less one day from NOA1.

i'm living with my parents and i have a good position in job also n i get vacation also.

but i dont understand about domicile.

if u can thn plz explain..

and another thing tht i forgot to mention is that i appoint attorney for my case.

so then may i go?

Hi,

You need to meet the financial requirements of the I-864 in order for your husband to get an immigration visa.

You need a US domicile - a US resident.

You need to have a current income or Joint Sponsor.

Having an attorney has nothing to do with "may you go?". You can go, but you may not meet the requirements. Read up on the domicile and income requirements.

Hi,

Having an attorney has nothing to do with "may you go?". You can go, but you may not meet the requirements. Read up on the domicile and income requirements.

as i told you i m living with my parents and my parents having home

and i hav a job also.

so plz suggest it is suitable to go now to india or may i go after my husband get visa interview appointmnet..?

please study the I-864,

under current annual income

and

prior years tax data.

do you qualify in both areas?

if not, suggest to think about securing a co-sponsor.

as to domicile proof, it is evaluated on interview day at the IV Unit. 'live with parents' can be explained, in written form in a continuation sheet, so bear that in mind. Lack of income, current annual income, will be something you need to address, but if one or both of your parents are co-sponsors, that base will be covered.

as to attorney - who cares? you are on a DIY site, where 'Y' 'D'. Try the advanced search tool, when logged in from a PC.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

How will you have a current US job living abroad?

Since you would not have a current US income by moving abroad, do you have a Joint Sponsor to meet the I-864 requirements?

You may want the research the I-864 requirements to make sure you can meet them after moving abroad.

She can have a current job if she is taking a leave of absence. Not everyone has to quit to have a sabbatical or leave of absence.

the thing that will make the difference for you, in making this decision:

1. current annual income per I-864P guidelines, the projection for 2014. Don't meet the mark? got a co-sponser?

2. ability to prove up domicile, proof given on interview day.

that's it. suss this out, then you'll have your answer.

You seem not to be understanding the responses. Let me see if a different explanation will be understood.

There are two issues.

1. Intent to re-establish US domicile as considered on interview day.

2. Your qualification to financially sponsor your husband, as evaluated on interview day.

In regard to both, you indicate that TODAY, you have a job but the important thing is whether you'll have a job in the USA, with income that will continue from that US source once you and your spouse come back to the USA to live.

You do not qualify based on today, because the visa decision is not made until interview day.

Will you continue to be employed where you are now employed, 1. during your absence AND 2. upon your return to the USA. If the answer to both is yes, you have no problem. Enjoy your trip. If your answer to either or both is no, then you've got some things to work out. If I were you though, I would consult your attorney about all this. That's what you're paying them for.
