Wife has Resident Alien Card and children need to file....

Well Met Everyone,

I want to thank you for reading my post. My situation is simple but I am still confused. My wife has her Resident Alien Card. We need to file for her children. The children live outside the US obviously, so do I apply similar to my wife's CR-1 process (CR-2) or can they come in while the petition is pending approval (K-4)? The children are 10 & 14.

This is the post I saw on the USCIS website:

Filing for Your Relative Who Lives Outside the United States

If your child, son, or daughter is outside the United States, you file Form I-130. The petition will be sent for consular processing after it is approved and a visa is available. The U.S. Embassy or consulate will provide notification and processing information.

It will be fastest for you to file as their step-parent, rather than for your wife to file as their natural parent. Expect the process to take approximately 12 - 14 months until they have their immigrant visas.

Did your wife get a K3?

A K-4 is a derivative of a K-3, they aren't standalone applications.

Yes. ~12 -14 months from whenever you file their I-130s (one for each child).

The process for the kids will be similar to the one for your wife. It will take approximately the same amount of time.

Why didn't you file for them when you filed for your wife?

This is my understanding of what to send:

I-130 for each child

Copy of US Citizen (me) Birth Certificate

Birth Certificate of each child

Marriage Certificate for their mom and I (translated-married in Mexico)

Divorce Certificate for myself and mom (Translated for mom)

My understanding is the G-325A is NOT needed

Where do I send the packet?

Do I have everything correct?

I believe petitioning for minors does not require a G-325A.
