Congrats on NOA2. Relax.. Take a look at the K-1 visa flow at k1flow under guides. Enjoy your time in the USA with your Finance. Looks like nothing will arrive in your home country until around the time you get back anyway. Follow the process and use the opportunity to make sure you bring back everything you'll need for the interview and subsequent part of 'your' process. Does not look like you'll be in your country for long before being allowed to return to marry that is GREAT for you. As for the affidavit of support. Based on a previous discuss thread you had your fiance provided support for another person and claimed on taxes by choice not by obligation. The affidavit of support only requires tax returns if he is self employed. Therefore if when he files in 2014 he does not intend to claim this person as a dependent than it may not be necessary for him to list that person as a dependend on the affidavid of support form. He can continue to contribute to that person's welfare voluntarily without actually listing them as a dependent if they indeed are not dependent upon him.. Therefore he may be able to file without his sister. If his sister is willing to be a co-sponsor this would (I think) only make your case stronger. When you get married apply for AOS and also apply for EAD (authorization to work) and AP (authorization to leave the country and re-enter) taking about 90 days.

Thank you so much for writing this. When it comes to the claiming the person on his taxes, so many people, if not all, in intent his thread said that he needs to put his nephew down on that form.. So that's why I wanted to get a co sponsor. Now I'm even more confused, lol. So many people told me that he needed needed to do that, I don't wanna risk anything, but I also don't wanna get denied my visa if i have his sister as a co sponsor..

prepare documents mentioned in the checklist and fill online form DS-160 (Which you fill in online at https://ceac.state.gov/GenNIV/Default.aspx ).

From Poland, you will need to have:

birth certificate(English translation if the applicant is not Polish)

police report(translation if needed)

medical examination results

2 photographs. (passport size)

affidavit of support form I-134 with original signature (from the petitioner)

Proof of relationship

Proof of visa payment

I got this information from the Warsaw embassy link in the "embassy info" link at the top of the page

Right, I've looked at the whole thing about the warsaw us embassy.

So basically once I have the new case nr I go online and fill that form ds 160? Is this how I schedule the interview.. And do u think should do it once I arrive in (end of may) or whenever we get the new case nr from the nvc, even when I'm still in America.

If his sister is willing then the surest way is to have her be a co-sponsor. His nephew is a gray area. With a co-sponsor the gray area becomes a don't worry about it area. The question is one of rather his Nephew is truly his dependent or not. For tax return purposes claiming a dependent can save him substantial money if he provided more than 1/2 of the support for his Nephew IN 2013... But for the state department they are more concerned about what his obligation is toward his Nephew. What would happen if his he stopped providing support for his Nephew? Would he live somewhere else and be claimed in 2014 as someone else's dependent. There is a lot of room for interpretation here and the circumstances vary based on the specifics. If Sister will co sponsor then that takes care of it. It's pretty late in the USA... late at night is never a good time to deal with these things little concerns turn into big concerns late at night.. Relax and enjoy your time together and tomorrow morning everything will look brighter and you can celebrate your NOA2 and advancement thru the process!

His sister can definitely co sponsor, I was just worried that they can question why my fiance can't. Cause I mean they will still see his taxes, or not?

I am sorry if I am a bother but i didn't expect this to take this little time to get approved and I'm just nervous and want to make sure.

you are at step 4 in that flowchart... DS-160 form online will be part of step 8 and won't be the longest part of step 8. I've done that and it's pretty straight forward to submit a DS-160. Make sure you and your finance have the documents you will bring to the interview that show proof of an on-going relationship so you can bring those back with you. Given you are in the USA now... take care to take some photos of the two of you together in the next month that have some date reference with them. For example if you go to a movie save the ticket stubs and take a picture of the two of you in front of a movie poster at the theater holding the ticket stubs (and hopefully the ticket stubs have a date).

I think you can now fill out the DS-160 when you get your case number. You can do it from the USA or from Poland. If YOU schedule your interview, as opposed to the embassy scheduling it for you (it varies by embassy), then I'd suggest scheduling it for a time beyond your return, allowing enough time for you to order your police certificate, military records (if any), a copy of your birth certificate (if you don't already have it), etc. If THEY schedule it, I'd suggest waiting to fill out the DS-160 until you are home and have the above documents ordered or already in your hands. Until then, though, get your fiance to gather his paperwork for the I-134 for you to take back with you, and also putting together your "proof of relationship" information, whatever you choose to include in that.

A personal note: my fiance was here shortly after we received our NOA2, and was here when I got our case number from the NVC. Our petition is on its way to Dublin right now (I got this information from the CEAC website I linked earlier), and he is waiting to get his police cert before going further with filling out the DS-160 or scheduling his medical exam. He wants to be 100% ready for the interview so his visa can be issued ASAP afterward. Good luck with what you decide. :)

I think you can now fill out the DS-160 when you get your case number. You can do it from the USA or from Poland. If YOU schedule your interview, as opposed to the embassy scheduling it for you (it varies by embassy), then I'd suggest scheduling it for a time beyond your return, allowing enough time for you to order your police certificate, military records (if any), a copy of your birth certificate (if you don't already have it), etc. If THEY schedule it, I'd suggest waiting to fill out the DS-160 until you are home and have the above documents ordered or already in your hands. No bother... everyone here is or has been in a similar situation... The what-if something goes wrong can be terrifying. The truth is the best way to go. Rather they look at tax returns or not will depend on rather he has to file them with the affidavide of support. Assume, unless he's self employed, that he does not. The reason your fiance can't is because he doesn't make enough money to support a household of 3. That alone is not a reason to deny a visa as long as there is a co-sponsor.

Thank you for being helpful, though I've been writing to people back and forth all day today, I'm still confused, lol. This is all so complicated.. We will definitely be taking photos and think of even more evidence to prove that our relationship is legit. It worked out well that I am here whole we got approved. And that I was here when we applied.

I did look thru many threads but I didn't see answers to everything... Maybe I missed it, I'm not too good at finding stuff out myself... This isn't an excuse or me being lazy, I'm not too good with forums, that's why I never really go to any but this one was a must :).

Guess I wanna ask if we gotta pay anything for the interview.. It didn't say we did but maybe I missed it.. I know I gotta pay for the physical and bring the bring them the evidence that we paid those $340 i129f petition money, right?

Could u also please tell me cuz I'm confused, the Vj thing for warsaw embassy, it takes about packets, all different numbers.. What is this about...like it said packet 2 needs to be sent or something. Do I need to mail the US embassy in Warsaw some documents? I thought I have to bring it all with me personally to the interview.

Hey guys, I'm making this thread because I didn't find all or enough answers to these questions that are bothering me. Maybe I have missed some stuff about what I'm about to ask and if I have, forgive me. If you could please answer my questions and not link me to different threads, I'd appreciate that alot. I hope I won't irritate nobody with this thread..

So a little bit about my situation. Today my fiance and I received noa2 in the mail. I am currently here in USA with him, I'm supposed to leave the country end of may. We also sent our petition in while I was here this time, we did that in the middle of March. We were fortunate enough to have our petition approved fast. Here are some of my questions..

1. Got ours noa2, what now? On the approval it says that they will not mail our thing to my country... But I've heard people say that they also should give us a new case number.. They didn't mention this in the letter we got today. I'll be home in a month, what do I do now and next?

2. My fiance doesn't make enough for three people, it's three cuz he claims someone on his taxes. Therefore we thought of making his sister my co sponsor. I'm wondering if this will seem weird to them... Could we possibly get denied?

3. After I'm here and we get married, I understand we ought to apply for aos for me... I've heard that takes a whileeee... But someone also said that while we waiting on aos, there's a way for me to legally work? Some employement ahthiraztokn thing?
