Seems like you get to re-apply, but for K-3. It would be unjust to deny your K-3 because the K-1 requirement (unmarried) was not met. "How did they find out?" <----- good question.

k3 isn't an option

Oh yea that's a good point. Thanks for pointing that out. I am glad it worked oit for us.

And oh one more thing I haven't mentioned, the ceremony happened after the interview and I was granted a visa. We scheduled the interview before the ceremony.

But yea, I would take your advise into consideration had I known it before.

For those that had the wedding after the K1 and before leaving.  They really check into things when you apply for usc and if they find out they may deny your USc and declare you entered invalidly and revoke all immigration rights after your invalid K1.

This will not be over quickly. You will not enjoy this.

A few things: based on what you are saying she admitted that she was married. So they may reject your K1 and give you a chance to file for CR1.

Also like a few people have talked about lifetime ban - its not quite right. I get amused when people don't want to go into specifics and just scare others in rough situation. If someone has provided incorrect information to CO which if known would have influenced the outcome then that is material misrepresentation and this attracts in admissibility yo the US. If the sponsor is USC or LPR then for their spouses hardship waivers are available which adds time and money. Yes this is a worst case scenario solution.

However since your wife admitted to co, it may be possible that they will come back and ask you to file spouse visa and that it will add 6-13 months depending on how soon your I-130 gets approved..!!!

Getting married and hosting a wedding are two different things... Anyone can get married (the legal act of joining two people in holy matrimony) for $200 but hosting a wedding for 200 guests (food, drink, location, flowers, photographer, DJ, dress, plane tickets ) can easily go into the 20k range here in the USA (I am a wedding photographer and planner) ... 9-10k for all that is pretty good as a cheapo wedding here is much more, especially considering there were 200 guests.

Although I still don't recommend getting married in home country on a k1, before or after interview,official,or not... I have seen waaaayyy to many cases where that backfires. If you need the big in country wedding, do it and file CR1 or K1, marry here, then go back later for big celebration. Don't risk immigration issues as what happened to the OP

Hi, I don't get your idea, you had a wedding ceremony in the Philippines but you did not sign the marriage contract, what's the point? I don't know if there's any sense to have a wedding ceremony and not signing the marriage contract. Ive read some posts here too like what you guys did. So I want to know the reason why.. ?

I have a friend who did have a traditional Catholic wedding ceremony in the Philippines, except that they did not register the marriage. It was just a celebration for the family, relatives, and friends who will not be able to come to the US wedding hehe. You know, Filipino families can sometimes be that sentimental. I am the only daughter among 5 children, so it's my mother's wish to see me get wed, but we opted for the K1 visa process because it is the most convenient route for me and my fiance. We promised to come back and have a wedding validation ceremony (the usual wedding ceremony) for them. So it's more of the sentimental reasons why some couples do that. =)

To the initial OP, from India.,,"What was you thinking?".,.,you were no doubt close to the K-1 being issued, ""WHY"" in the world, would you think you can fool USCIS, and now my friend, YOU have a 1-2 year journey with I-130,..,.. I just hope your loved one did not try to deceive USCIS,..,.,if so they may never get to come here!

This is without a doubt the worst decision for people going through the immigration to the USA, to make I have ever read on this site.,.,,..,what in the world was you thinking?

Did you put family and friends before you and your wife to be? If so,.,.,I would have to question your motivation, family and friends, OR YOUR, to be ""wife""

That's what happened to me and reading to posts here scares me because though I am already here in the States, I still need to file AOS. I hope and pray that the USCIS will not see it and that everything will work out fine. For now, we have a lawyer helping us with the processing of papers.

What you did/are doing is a wise decision: go back to hold a ceremony.

I applied for k1 in September we didnt even had a plan to get married I haapend to go to india we decided to do the weeding but in my eyes I was thinkin in US even if even if go to church and do the ceremony we still not married couple until we go to court house and do our weeding. And pkus my weeding is hasnot been registered in india so I am still married or I can do some about this

If it looks like a wedding, then it's a wedding.

Look through this site and see how many people like you think it is okay to have a wedding and not register it.

Look at the warnings not to do it because the US Embassy will deny the k-1.

You made foolish mistake by not researching this.

The US Embassy did not do anything wrong.

The mistake is yours for not researching the consequences before you acted.

Yes, you could have waited and gotten the K-1. But, you didn't wait. You thought you had a way to outsmart the US Embassy by not registering the marriage. You disqualified yourself by choosing to do what you did.

A courthouse wedding is an option for marriage, not required. Once you get a marriage license in your town in the US, anyone from a judge to a Justice of the Peace to a minister or other authorized figure can do the marriage.

If you're married in another country, you're married in the US. It's that simple.

You were wrong. The only option at this point is to file for a CR-1 after you get the denial notice, providing she isn't permanently barred from the US.

November 14th, 2013: She's here!

December 12th, 2013: Picked up marriage license.

December 14th, 2013: Wedding
