k1 visa denied to getting married

It's good that you went that way and it worked out for you, but I would advise people to steer clear of anything that even resembles a marriage while they're in the K-1 process. One errant photo of a wedding looking ceremony on social medial posted by a friend or family member could lead to a denial.

A gathering of friends and family to celebrate an engagement and/or leaving party with nothing that could be misconstrued as wedding attire is a much better and safer bet.

And oh one more thing I haven't mentioned, the ceremony happened after the interview and I was granted a visa. We scheduled the interview before the ceremony.

But yea, I would take your advise into consideration had I known it before.

That has also been known to haunt people and cause problems later.

These so called blessing ceremonies have been getting more common in the Philippines with K-1's, and the embassy is going to react eventually, as they have done in the past. It will not be a good thing when they do.

Yeah I also wanted to say that I hope u held the ceremony after the interview and when u have the visa in hand. But glad that's what u did. And I'm glad it worked out for you both. :).. Thank you all for the reply..

Can a spouse visa be denied because of the K-1 denial?

Yes an no.

What did she say at the interview? Did she deny that she was married? Did she at any point lie to the consular officer? If so, she could very well have triggered a lifetime ban for material misrepresentation. Her spousal visa will then be denied because she lied on a previous visa application.

If she didn't lie, then the K-1 denial will have no bearing on a spousal visa, and you'll just have to start from scratch again.

K-1 visa is a fiance(e) visa. You cannot get a K-1 if you're already married.

I was searching for answers to this question and this is what I found, which I thought my be of big help:

4.11)...My alien fiancee has been issued a K-1 visa. Can we get married abroad and then come back together to the US with the K-1?

A...No. The alien must NOT be married when s/he enters the US on a K-1 visa. Also, if using the K-1, the couple must marry in the US within 90 days of the alien entering on the K-1.

(FAQ Note: Some couples arrange to have a non legal ceremony prior to the fiance(e) leaving their home country, in order to satisfy the wishes of family, or to have a celebration if the family is unable to travel to the US for a wedding.

A...The government distinguishes between legal and non legal marriages. If the marriage is legal in the country in which it is performed, the US will consider it a legal marriage. It doesn't matter if it is a civil or religious marriage.

Maybe the law is different in the Philippines but here in the US, if you participate in a wedding ceremony officiated by a cleric, you are legally married. If a "blessing" ceremony counts as a marriage, you violated your visa even if you fooled them by having the ceremony post K-1 issuance. It also means that the US marriage, which is the foundation of your AOS, is void ab initio, which could be the basis to revoke your green card at any time in the future.

While it may keep your fiance's family happy, it does not strike me as a particularly smart idea.

I do not know how she could ha e gone to a K1 interview without lying.

At the interview they asked her if sh was got married she answered no the consulate lady said dont lie mam you got married on this date. Then wife answers yes she said dont lie mam if you lie more you could be ban know all you have to wait for for our letter and we will tell you what else paperwork we need from you due to not notified no one. And also consulate said we know your relationship is not a lie we believe that

At the time I applied for her k1 we were engaged in that process I had to go to india in a emergency and my grandmother was really sick and thats when we got married

They mail letters so people don't make scenes at the embassy and they can move on to people who aren't permanently banned from the US.

November 14th, 2013: She's here!

December 12th, 2013: Picked up marriage license.

December 14th, 2013: Wedding

Hi,

How did they found out? Ite because the moment you got married and sign the marriage contract it will be sent to the authorities who handle each persons record like NSO in the philippines.

Hope everything will be fine!
