Here's my case:

Arrived in the US: July 26, 2010

I-94 Expiration: October 24, 2010

Married: August 8,2010

Daughter was born: 2012

We procrastinated for years, many things happened: had to save money, a new member added to the family, passport expiration, etc. I am a stay at home mom/wife, never worked and never traveled outside the US since I arrived here. Since my medical tests expired already, I took a new one and ready to apply for AOS. But I don't need to work nor travel soon.

Anyone here with the same, if not almost the same, case as mine, what were the problems you encountered?

My forms are ready: I-864, G-325A, G-1145, I-485, I-693 (sealed from the medical examiner).

These are the evidences I have, original and photo copy:

1. birth certificate

2. My old passport with the K1 visa

3. New passport

4. 2 passport photos taken within the last 30 days

5. NOA of I-129F petition

6. marriage certificate

7. I-94 arrival document

What else do I need? What else do I need to do?

PS. A cover letter will also be added to my list.

Any help will be appreciated.

For the evidences...send copies not originals! Also add some bills with you and your spouse's names listed on them...ie rental, power,water,phone bills etc oh bank statements too and tax transcipts added to the I-864 will be helpful too ! Doulble check to make sure you send the right fees!

Oh yea, and that too. We actually just printed about a half to 3/4 inch thick of tax transcripts. But we haven't thought about the bills and bank statements with our names. Thanks for the input.

The only evidence you need to send is supporting documentation for the I864..This is evidence to show you meet the minimum financial requirements. (last 3 years of tax transcripts, letter from employer, bank statements ) You do not need to send utility bills, rental agreements or pictures, etc at this time - If you get selected for an interview you that is when you will need to show that kind of evidence.

From the AOS guide:

the supporting documentation for the I-864 form: letter from employer confirming employment, the last 3 years of tax returns, plus any documentation of your financial resources if you choose to include this. The rule is, if your income is not 125% of the poverty level for your family, you will need additional financial documentation. HOWEVER, if you read the form instructions carefully, it states that while they do NOT require additional financial information IF you have at least 125% of the poverty level, it says the USCIS can still ask for that information if they want... so in order to potentially avoid future questions, many people include financial information, including bank letter, letter from stockbroker, letter regarding mortgages, copy of deeds to a property, and any other financial assets... etc. It is far better to include too much information rather than not enough.

I think at this point you may also need I-130. Maybe someone with more experience will have some input on this.

You may want to include an I-130 as well. That will ensure that you receive a 10 year green card, if you file for AOS based on the I-130 instead of the I-129F. Then you will not have to file to remove conditions. The I-130 is $420 and ROC is $590.

Though you can still apply based solely on your I-129F and getting married within 90 days of arriving. You will not need to add any proof of marriage other than a copy of your marriage certificate in tht case.
