Believe it or not this is the best forum for relieving immigration headaches!!

Okay so i received an RFE couple days ago....i received about 6 pages yellow colored papers, kinda scary but i got to find out that the only one that could give me chronic headache was the i-864 which is common around here, so first they said the i-864 they received wasn't sent from the sponsor so first question is does the sponsor have to send it himself( They repeated the rfe Twice) and also they said the joint sponsor didn't meet the 125% requirement.....so my question is here is am really confused about what they mean here........ cuz the i-864 i sent out was filled by a bud of mine hes an active member of US military beside his income i believe was more than 26k no wife no kids and he has about 5 other Assets including his 2 vehicles, and houses....but the thing was that at the time we send out my package we didn't include his tax docs and other document you know since its optional so we didn't include it.......so IM SUPER CONFUSED RIGHT NOW since my wife who is my petitioner didn't file any form i-864 shes a Graduate student she doesn't work to earn that much or lest say she work maybe less an 30hrs/wk.....and they said my joint sponsor income was enough like really? cuz i was thinking they said it wasn't enough B.cuz they didnt see any evidence like tax papers and co..or my wife who's is the petitioner have to be the sponsor-er too or what is possibly going wrong here.so plz answers would be so greatly welcome..even inbox messages is highly allowed :clock: :clock:

"Tax docs" aren't optional; if you don't include them they will RFE you, as they have done.

For a spouse-based AoS, the petitioner is always the primary sponsor regardless of income (even if it's $0), so your wife must complete an I-864 of her own.

You will need a copy of the complete tax return for your joint sponsor, which will be their 2013 return. Your joint sponsor must demonstrate $19,662 in income to qualify as your joint sponsor.

Your wife will also need to submit her 2013 tax return with her I-864. If she was not required to file then she must write a short letter explaining why she was not required to file.

as Stated above your Wife and Your Buddy need to fill out a form I-864 EACH even if your wife doesn't meet the requirements she is still the petitioner and the primary sponsor. Your Buddy is the JOINT Sponsor who Does meet the Requirements. EACH of the have to send copies of Required Citizen or LPR Verification like copy of green card or US Passport and They each have to send their 2013 Tax Return Transcripts. If your buddy has no kids, wife or dependents then he would have to earn $15,730 and from what you said he meets this since he is a member of the US Military. Your Wife Would have to earn $19,662. Here is Where I found this information: http://www.uscis.gov/sites/default/files/files/form/i-864p.pdf Good Luck!

Thanks so much...you mentioned somewhere there, they have to send 2013 tax return transcript....is it only the tax transcript and also is it for 2013 alone or three recent years as stated on the form?

When you fill out the form I-864 it is REQUIRED to send the 2013 TAX return transcripts the other 2 years are the optional ones. Since You Already got an RFE on this form I Would Suggest playing it safe and send all 3 years for your wife AND your buddy.

I believe when a member of the military is a joint sponsor they have to be at 125% of the poverty guidelines, not 100%, because the guidelines explicitly state they must be sponsoring their own spouse or child to be able to use only 100%.

i said up there he has no wife no kids, apparently no dependents so it should be about 100% also even if also meets the 125%

okay one other thing is that the form i-864z is what my friend will fill out right and not the regular i-864 which the petitioner would fill

A joint sponsor cannot use an I-864EZ; they would complete an I-864 of their own.
