General questions about ROC and bring my family

Hi everyone,

Let me know your opinion.

I will fly under k1 visa and hopefully me and my fiancé can "breath" for a while before continue our immigration journey. Here is my questions:

1. We can apply ROC after 2 years conditional GC. Is this true?

2. When we apply that in 2nd year, should we get the Permanent resident GC for me?

3. On 3rd year, can we apply naturalization for me? I have mom and 2 younger brothers (13y.o and 5 y.o) and would like to bring him to the US after I get ONLY citizenship (thought I will more settle then just being permanent resident)

4. If I just sponsor my mom, then when she become permanent resident, can she sponsor my brothers? or better I sponsor all of them at the same time?

NB: I will work in States as well; not just my fiancé so I need to educate myself about how the visa going . At least I will have some ideas how we will work this things out.

After you marry you need to file for Adjustment of Status to get a Greencard. WHen it is approved, it will be good for 2 years. Within the 90 days before it expires, then you will need to file for ROC.

Then once you have been a permanent resident for 3 years, and have been married to the same USC for 3 years, you will eligible for naturalization.

Once you are a USC you can petition for your mom, and she would petition for her kids once she has LPR.

So, you mention that you can breathe after you marry, that's not really true. You need to file for AOS as soon as possible. Then you can take a little break for 2 years.

Ok..here is my specific plan:

Fly: 19th May

Marriage: 30th May-Court house

SSN: First week of June

AOS, EAD and AP: If possible as soon as i get my SSN (?)

You don't need the SSN to get file AOS. You just need to get married.

Personally, I would get the SSN in maiden name before the marriage, because many times the SSA people are clueless and deny a K-1 a SSN after they marry, but your plan sounds fine. If that happens there are plenty of other chances to get a SSN soon thereafter.

Hi.

There is no way for your brothers to immigrate with your mom. You can file for all of them at the same time, but their waiting time will be different. It takes 1 year for a USC to petition a parent. It takes 12-24 years for a USC to petition a sibling.

Once your mother becomes an LPR, she can file for her minor sons. This takes 2-3 years.
