how do we do a name change for home country of Ecuador

Hey I have a question.

My wife now has my last name and we need to get it changed for her home country of Ecuador too. We were recently back in Ecuador and they said we had to do the name change here at the Ecuadorian consulate and get new Ecuadorian passport here in the US. We just called the consulate and they said they do not do that. Does anyone know what the process is? thanks!

Is it necessary to change it there? Mrs. T-B. has my name here and hers there, and it has caused no problems. She's a USC now and just traveled there, using her U.S. passport exclusively; everything went very smoothly.

That having been said: If you have your minds made up to complete the name-change, call the Ecu Embassy in Washington, DC to learn the exact steps. I don't know about the name-change part, but if it's as easy as I've heard it is to renew an expired Ecu passport from here, I would think that it shouldn't be that much more difficult to do it after a name-change (presuming that all documentation is in order). Let us know what you learn from the Embassy in DC.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

They don't do the name change in the Ecuadorian passport. If she wants proof that she's married to you and make it legal in Ecuador, you guys should get her a new Cedula, where they'll add that she's married and they'll validate your marriage in the Registro Civil for a fee.

09/05/2013: Visa in hands

11/01/2013: Moved to the US (POE Miami)

12/03/2013: We got married!! heart.gif

01/06/2014: AOS package sent to Chicago Lockbox

01/17/2014: NOA1

02/13/2014: Biometrics appointment

03/13/2014: EAD and AP approved

04/22/2014: Case touched, change of address

04/30/2014: Notice of potential interview waiver case received

ok, the problem is that they would not recognize us as married in Ecuador when we tried to buy property in Ecuador in both of our names. I got a response from the Ecuadorian consulate stating:

Dear sir

That's not possible. According to ecuadorian laws, the wife does not change her last name to her husband's, what can be done is putting a note on the observations page of her passport saying she's married and what her name here in the US is

Atentamente,

===============

That does not help us for being recognized as married in Ecuador.

The next step is trying the Ecuadorian embassy in Washington DC as suggested by TBoneTX. The important part would be being recognized as married, if they would do a name change too that would be a bonus.

I see... Sorry to say it again, the name change won't happen. Now, what they can do is recognize the marriage and the thing is, that is actually something the Ecuadorian consulate can do http://www.registrocivil.gob.ec/?p=1676. Not sure if you speak Spanish but this is the documents you'd need:

  • Cédulas de Ciudadanía o Identidad (en el caso de ecuatorianos).
  • Cédula de Identidad o pasaporte (en caso de extranjero).
  • Certificado de matrimonio debidamente legalizado o apostillado por la autoridad competente, y legalmente traducido si fuera el caso.
  • Razón de inexistencia emitida por la oficina de Registros del Exterior de la DIGERCIC (Agencia Matriz Quito).
  • Certificado de Movimiento Migratorio de los contrayentes.
  • Con la documentación se procederá a realizar la resolución administrativa para su inscripción.

I plan on doing this myself next year when my husband and I go to Ecuador, good luck and let us know how it goes
