I am not sure where to post this and couldnt find other topics related. I was under the assumption that after applying for DS-260 and my husband having his CR-1 visa approved and entering the states that a social security card would be sent because we selected on the application our request for a social security number. I found out two weeks ago that we needed to go to the local social security office to apply for that.

When we went to the Social Security Administration's local office to apply for the SS card we found out that my husbands name is not in the correct order on his visa therefore the ss administration had it that way also!! The woman said it would take roughly four weeks to have it approved before they could issue the card. So we went ahead and requested the card the way they had his name in the system, and with her advise contacted USCIS to see if we can get it corrected before the green card is issued. A few days later we went to our local USCIS office and confirmed that USCIS had his name wrong because the visa was issued with his name in the incorrect order.....this may sound confusing but I know they say to check your visa when you receive it to make sure all the information was correct. For my husband the name was correct because it was spelled properly and so on. The issue was that in his country they state the name last, middle, first. We state our names first, middle, last. But on some official documents like my passport the name is stated last, first, middle. How can someone keep up with all of that??

So we had to call USCIS since the local office could not correct the issue, I was able to speak to a supervisor and have it corrected since the green card has not been issued yet. Today we went back to the SSA to request a ss card with his correct name, they didnt have the updated information in their system from USCIS, so they said they have to get it approved from immigration before it can be issued. But they were able to give us his ss#. When we got home the first card we requested came in the mail.....

My question is can he start working since he has his SS# even though we have to wait for the name to be corrected and a new card issued? If he does use that card can he state his name correctly on applications and I-9's? I dont really know where to ask these questions, but also I want to inform others so that they wont have the same issue!!

i suggest:

find a buddy or friend or acquaintence that uses e-verify,

and then look him up in e-verify,

report back here when able.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

The crazy part of all of this is that USCIS had my husbands name correct through the whole petition process...the consulate officer who processed his Visa entered his name incorrectly and that is the information that USCIS had to be generated on his Green Card! I am glad that we could resolve it, Im just hoping that it really is resolved and we dont receive his Green Card with the incorrect information.

I was able to find out about e-verify. There is a self check option. There isnt enough information on my husband, meaning he hasnt been in the states long enough to do a self check... :oops:

USCIS denied our 'request,' (didn't know it was a request, thought they actually fixed the problem), to correct his name on the visa. Said we could file I-90 to correct the green card that we haven't received yet and would cost over $400 to do!

that's certainly 1 opinion (from USCIS)

most folk that have USCIS-caused ERRORS on the greencard

send off the I-90

with a letter of explanation,

asking for the fee to be waived, as it is an error from USCIS.

and then they get the card issued again without the errors, no fee to pay.

You could certainly knock around a local USCIS office for a day, in on an infopass appointment, and get the shift supervisor to fix all this prior to green card printing stage,

but

it ain't a trivial thing.

are you talking to ISOs at USCIS via telephone? This is not the first person that answers the phone - that's a CSR, and mostly, they are useless.

I talked to the ISO on the 18th and they said it was fixed! Until I received the letter saying I would have to file a I-90. Went back to the local USCIS office and she said there was nothing she could do......blamed my husband for not noticing it and then proceeded to tell us that his passport says "postname" meaning second last name not middle name!!! I said that is how they translate that in french!!!! His passport distinctly shows three separate names but yet he was given two last names on his visa. I then said that we will just leave it because we cant afford to dish out another $450 to fix their mistake, and she insisted that it could not be left this way, "someone cant come here and just assume a different name!!" She says!!! And I said if you would fix it then he wouldnt have to go by a different name! To make matters worse the green card still hasnt been created so its not like its too late to fix it!!

But thank you for the advice, we will try the waiver thing! This is so trivial!! :ranting:


She also said that we have to wait for the card to be issued before we can file the I-90...If we know there is a mistake now then why wait?

I dunno, I think it's worth another trip into USCIS and getting a supervisor. Gotta be adamant, bring stuff in that you made copies of along the way, as well.

Scant chance that it might get fixed at a CBP office, but it's worth a shot (this isn't a USCIS office, fwiw) so I'd try there as well.

If your ELIS record is correct, then you should be able to slam on a supervisor at the USCIS infopass appointment.
