hi every one,,,i will not go on with details on how my life is since I got to the state as good ,loving husband ,to cut this short ,we lived in my country for almost a year, I moved to states 9 months ago ,im living with crazy,moody,liar,game play person ,,who hates others and jealous of everyone,i tried my best to make good life with her ,, she wants me to love her under her rules only ,she is most talkative person ever,,guess what ? she is around 50 and living with her mother who controls her like a puppy- she refused to move ever to a place for us,, ,and they did same to me,, I called the police manytimes,,as I fear for my life after threatening me,,and lately found out she filled divorce,,i still think our life together is still possible if we move out,,im still at home with them and I have no place else as I not want to end this marriage,i really love her ,i not want to sign divorce papers ,, will that help?

if she got divorce will I be able to adjust my status alone? will our marriage considered as ended from date of filling divorce or from date divorce decree issued as final?

will I have to go for ins right after divorce to adjust my statues from conditional GC or I must wait for 2 years period?

im so broken ,,thought im love of her life as she is to me ,but she says now she never loved me, plz help

Maybe if you both moved back to your country, seems the US is the issue?

It seems you came with CR1 visa, then now you will not adjust status, but you have to file ROC I-751( it's for those with green card already) after your divorce is finalized. As soon the divorce decree is ready then file I-751 waiver,she does not have to sign,you must prove bonafide marriage,showing commingling finances(joint bank account,tax return filed jointly , utilities bills in name of both,lease agreement etc...)without these documents your chances to have your ROC approved is almost non existent.

I heard people saying all the time"I want to save my marriage,I love her" ,really? do you really think your love is enough? course not, love has to be reciprocate in order for your marriage to be saved.

You're going to have a very hard time doing it on your own, if even possible, which is unlikely.

December 12th, 2013: Picked up marriage license.

It doesn't matter if you sign the divorce papers or not, the Judge can grant the divorce without your cooperation.

Date the divorce is filed is inconsequential.

Date of the divorce will be dependent upon the wording of the divorce decree and the state you reside in. It is possible that the divorce could be effective prior to the date the actual decree is signed.

She sounds like she just has had a couple of bad days. I am sure it will blow over.

There is really no need to ask people on here what to do. All you need to do is ask God and he will provide the answer. No need to sweat the small stuff.

She's filed for a divorce it's not an argument over who does the washing up is it? Hardly small stuff!

Going by your post are you more interested in staying in your marriage or staying in the US?

You talk of how much you love her despite her many faults that you point out, then immediately ask if you can still adjust status on your own.

If you're only in the US for love then why would you want to stay without that love?

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Indeed. Fishy. OP, your first question was vague and for general opinions; prior to that making it evident that you think poorly of your wife; and then your second and third questions were all specifically about the status of your GC. I wouldn't want to stay in the US if my marriage had disolved.
