Hello All,

Please I am somehow confused at this point. I mailed two separate i-130 for spouse and child in March. I got Notice of Acceptance for both and I thought this rest could take up to six month.

I got another Notice of Approval few days ago, and it stated that both original application had been forwarded to Department of State National Visa Center (NVC).

Its shows Priority date is March 24, 2014. This is where I got confused, why does it show March 24, 2014 as Priority date? what does it mean? is it current? Also, how long does it gonna take at NVC?

It also shows 203 (a) 2 (A) INA . Please can someone people enlighten me. Thanks in Advanced

Are you a Citizen or still a Permanent Resident? Your current status determines how long you will be at the NVC. Your priority date is the date USCIS received your case.

Citizen. Does my priority date means current?

If you filed the i-130 as a USA citizen, you dont need to worry about priority dates. Your category doesnt have a numeric limitations and visas are always available to your relatives

now that USCIS approved your petitions and are on their way to NVC, you should start preparing all documentations for AOS an IV forms to be completed,,,

Find the forums of US Citizens petitions for their relatives , even though NVC processing is the same you might be able to go through it faster due to your citizenship status

I second what PatchSc said. However I noticed the code you posted above in your first message normally goes for Spouse and minor children of Permanent Resident F2A. When you first filed your petition last month were you already a citizen or you just became a citizen this month? If at the time of filing your petition last month your citizenship was still pending. You made need to upgrade your petition to Immediate Relative of Citizen IR-1/CR-1 when your file gets to the NVC.

You are correct, I was a LPR. I just became USC.

Ok I see. Once your case arrives at the NVC and they enter you in their system, call them and have them upgrade your petition to Immediate Relative of a Citizen. To do so you will have to send a copy of your Naturalization Certificate or a copy of your US Passport. Call the NVC in about 30 days to check if your file is there. Once you upgrade you petition the NVC will send you instructions on how to proceed with your case.

Ok, thank YOU. Does that sound like I can have my family here within 5months? how can I make it fast? My baby is sick, and I am not satisfy with the treatment she's being getting at the hospital back home. How can I get her alone here ASAP for proper treatment?

You are so welcome. I think you could probably get through the NVC in 5 months and have your interview date. When it comes on to the interview after your wife gets approved they may put her in Additional Processing (AP) so she might not get her Visa right away. It can take several days to several weeks for her Visa to be printed. Sorry to hear about you daughter, I think you should speak to the NVC once your case gets there and see if they can have your case expedited. All the Best:-)

what if you are LPR?

LPR visas for their relatives are subject to numerical limitations, and once you file a petition you´ll have to wait a certain amount of time till your PD becomes current in the Visa BUlletin which means that there´s a visa available, if your PD is not current or within the cutoff date of the must current visa bulletin you´ll need to wait till it becomes current.

Even though the process has changed a lot, before for LPR the process of petition and completion took almost 2.5 years.. now it has reduced to 1 year. And if the Immigration Reform its approved the LPR process will be equal to the US citizens.
