what can we do? neither of us can go to canada

what will happen to us if we can't pay and can't go to court?

Can you not just pay the two months rent? Couldn't they just backdate and say the day you said you were leaving was your "notice" and that you had to pay rent for the two months following?? DId you pay first and last months when you moved in? IF so, then you really only owe one month's rent....

You could try and find your lease and see if it says anywhere on there that you're required to give 60 days notice, because if the lease doesn't say that, then they can't sue you. You can't hold someone accountable for a rule they didn't know existed.

I'd suggest trying to first talk to the landlord and see if you can just work this out outside of court. Try explaining the extenuating circumstances of your case (that you were deported and got a surprise visa).

i highly doubt we still have a copy of the lease. we didn't think we'd need it again! yes, when we moved in, we did pay first and last month's rent.

we're in the middle of not being able to find jobs and moving to a different city as a result... so money isn't something we really have. if we pay the 2 months that they want, we won't be able to move, and if we can't get jobs here, we'll be totally screwed.

i'm definately going to call the landlord and find out what's going on and if there's anything we can do. .... i thought nizzar had been going month to month with them at the end ... and if so, this doesn't make a bit of sense.

I'm sorry to hear about your apartment troubles.

I've lived in Toronto and usually you sign a lease for the first year. After that, you can go on a monthly basis.

However, I've also lived in Hamilton where I had to sign a yearly lease. I left my apartment before my 4th yearly lease was up (I lived for almost 4 years there). I had to give them a 60-day notice. And even after I've given them the 60-day notice, they still deducted $ 100.00 for early termination of lease, $ 30.00 for advertising that the unit was available and $ 5.00 for doing a credit check on the new applicant. They basically took out $ 135.00 from my deposit. The thing that bugged me about it was that they didn't even need to advertise for the vacancy because it was an apartment building that was highly sought after (and they always have a waiting list) plus I thought the landlords always did a credit check on applicants anyway. :angry:

I hope the landlord will allow you to settle this out of court. Good luck!
